Public Hearing: No one came forward to address Ordinance 09-1263. MOTION: Commissioner Solomon moved to approve Ordinance 09-1263 on second reading as presented. Motion was seconded by Commissioner Miller. Motion carried unanimously by voice vote 5 - O. B. Second Reading of Ordinance 09-1272 - Voluntary Annexation of City-Owned Parcel on Wilshire Boulevard (Parcel No. 20-21-30-300-0A1H-0000) The City Clerk read Ordinance 09-1272 by title as follows: "AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, RELATING TO VOLUNTARY ANNEXATION; MAKING FINDINGS; ANNEXING TO AND INCLUDING WITHIN THE CORPORATE LIMITS OF THE CITY OF CASSELBERRY, FLORIDA, CERTAIN LANDS LOCATED IN SECTION 20, TOWNSHIP 21, RANGE 30; REDEFINING THE CORPORATE LIMITS OF THE CITY OF CASSELBERRY, FLORIDA; PROVIDING FOR THE INTERlMPROVISION OF LAND DEVELOPMENT REGULATIONS; PROVIDING THAT CERTAIN COUNTY LICENSEES FOLLOWING THEIR BUSINESS, TRADE OR PROFESSION WITHIN THE LANDS TO BE ANNEXED MAY CONTINUE TO FOLLOW SUCH BUSINESS, TRADE OR PROFESSION THROUGHOUT THE ENTIRE CORPORATE LIMITS WITHOUT THE NECESSITY OF FURTHER QUALIFICATION THEREFORE; PROVIDING THAT EFFECTIVE IN ACCORDANCE WITH LAW THE TO BE ANNEXED SHALL BE ASSESSED FOR PAYMENT OF MUNICIPAL AD VALOREM TAXES; DIRECTING THE CITY CLERK TO FILE CERTIFIED COPIES OF THE ORDINANCE WITH THE CLERI( OF COURT AND THE SECRETARY OF STATE OF THE STATE OF FLORIDA; AND PROVIDING FOR CODIFICATION, CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." Notice of Public Hearing: The Notice of Public Hearing relative to Ordinance 09-1272 was published in the Orlando Sentinel on February 22,2009 and March 1,2009. Staff Presentation: Mr. Gerald Paradise, Community Development Director stated Ordinance 09-1272 provides for annexation of City-owned vacant land located on Wilshire Boulevard, south of State Road 436. The lands to be annexed consist of approximately .73 acres which are adjacent and contiguous to the City limits, will not create an enclave, is reasonably compact, is an urban area as defined in the criteria and meets the statutory requirements for annexation, as established in Chapter 171, Florida Statutes. The subject property has Seminole County future land use designation of Commercial and a C-2 (Commercial) zoning designation. The City Commission approved Ordinance 09-1272 on first reading on February 23, 2009.
