Second Reading of Ordinance 09-1263 - Voluntary Annexation of the City-Owned <br />Parcel on Wilshire Boulevard (Parcel No. 20-21-30-300-0A1C-0000) <br /> <br />The City Clerk read Ordinance 09-1263 by title as follows: <br /> <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, RELATING TO <br />VOLUNTARY ANNEXATION; MAKING FINDINGS; ANNEXING TO AND <br />INCLUDING WITHIN THE CORPORATE LIMITS OF THE CITY OF CASSELBERRY, <br />FLORIDA, CERTAIN LANDS LOCATED IN SECTION 20, TOWNSHIP 21, RANGE 30; <br />REDEFINING THE CORPORATE LIMITS OF THE CITY OF CASSELBERRY, <br />FLORIDA; PROVIDING FOR THE INTERIM PROVISION OF LAND DEVELOPMENT <br />REGULATIONS; PROVIDING THAT CERTAIN COUNTY LICENSEES FOLLOWING <br />THEIR BUSINESS, TRADE OR PROFESSION WITHIN THE LANDS TO BE <br />ANNEXED MAY CONTINUE TO FOLLOW SUCH BUSINESS, TRADE OR <br />PROFESSION THROUGHOUT THE ENTIRE CORPORATE LIMITS WITHOUT THE <br />NECESSITY OF FURTHER QUALIFICATION THEREFORE; PROVIDING THAT <br />EFFECTIVE IN ACCORDANCE WITH LAW THE TO BE ANNEXED SHALL BE <br />ASSESSED FOR PAYMENT OF MUNICIPAL AD VALOREM TAXES; DIRECTING <br />THE CITY CLERI( TO FILE CERTIFIED COPIES OF THE ORDINANCE WITH THE <br />CLERI( OF COURT AND THE SECRETARY OF STATE OF THE STATE OF <br />FLORIDA; AND PROVIDING FOR CODIFICATION, CONFLICTS, SEVERABILITY, <br />AND EFFECTIVE DATE." <br /> <br />Notice of Public, Hearing: The Notice of Public Hearing relative to Ordinance 09-1263 was published in <br />the Orlando Sentinel on February 22,2009 and March 1,2009. <br /> <br />Staff Presentation: Mr. Gerald Paradise, Community Development Director stated Ordinance 09-1263 <br />provides for annexation of City-owned vacant land located on Wilshire Boulevard, south of State Road 436. <br />The lands to be annexed consist of approximately 1.41 acres which are adjacent and contiguous to the City <br />limits, will not create an enclave, is reasonably compact, is an urban area as defined in the criteria and meets <br />the statutory requirements for annexation, as established in Chapter 171, Florida Statutes. The subject <br />property has Seminole County future land use designation of Commercial and a C-2 (Commercial) zoning <br />designation. The City Commission approved Ordinance 09-1263 on first reading on February 23, 2009. <br /> <br />Budget Impact: The subj ect property is valued at $276,701 and currently provides nothing in County or City <br />property taxes since it is owned by the City and therefore exempt. <br />
