U.S. Highway 17-92 (Floors Direct) - Case <br />No. CE-08-00341 <br /> <br />Staff Presentation: Police Chief Jim Ruf, came forward and gave the presentation for Code Enforcement <br />Case No. CE-08-00341. The violation was for overgrown property. A Notice of Code violation was sent to <br />the owner of the subject property on February 22, 2008 with a date certain of March 12,2008 given for <br />correction. The property was inspected on March 14, 2008 and was found to still be in non-compliance. An <br />Affidavit of Notice of Code Violation and Request for Hearing was sent to the property owner on March 17, <br />2008 with a date certain of April 9, 2008 given for correction. The property was reinspected on April 1 0, <br />2008 and was found to still be in non-compliance. The Code Enforcement Board issued a Finding of Fact <br />on the case on April 1 0, 2008 with a date certain of April 2S, 2008 given for correction or a fine of $7 S per <br />day would be imposed. The property was reinspected on April 28, 2008 and found to still be in non- <br />compliance. The Code Enforcement Board held a hearing on the case on May 8, 2008 and imposed the fine <br />since the property was still not in compliance. On May 23,2008 the Order imposing the fine was recorded <br />with the official records of the Seminole County Clerk of Court. On September 10, 2008, Mr. John <br />Winkelblack assumed management of the property and contacted the City regarding the code violation. On <br />October 6, 2008, the property was found to be in compliance and there have not been any further violations <br />since that time. A request was received on behalf of the property owner from Celeste Carr, Vice President <br />of Operations, for a reduction or waiver of the lien. Ms. Carr stated the previous managers had assured the <br />property owner that the code violation was resolved. However it was not until Mr. John Winkelblack <br />assumed management ofthe property that the property came into full compliance on October 6, 2008. The <br />Code Enforcement Board, at their January 8, 2009 meeting, recommended that the lien placed on 383 4100 <br />S. U.S. Highway 17-92 for Case No. CE-08-00341 be reduced from $12,300 to $3,000. <br /> <br />Mr. John Winkelblack, Floors Direct Manager, came forward and requested the City Commission reduce the <br />lien as recommended by the Code Enforcement Board. <br /> <br />Budget Impact: Impact to the City Budget would be an increase of $3,000 to the General Fund. <br /> <br />Recommendation: The City Manager and the Police Chief recommended consideration of the Code <br />Enforcement Board recommendation to reduce the lien amount from $12,300 to $3,000. <br /> <br />MOTION: <br /> <br />Commissioner Miller moved to reduce the lien on 4100 <br />S. U.S. Highway 17-92 from $12,300 to $3,000, as <br />recommended by the Code Enforcement Board. <br />Motion was seconded by Vice Mayor Hufford for the <br />purpose of discussion. <br /> <br />DISCUSSION: <br /> <br />Discussion ensued regarding concerns about the reduction to 2S% of the original <br />fine recommended by the Code Enforcement Board. The Commission expressed <br />gratitude for the property being brought into compliance but the impact of the <br />extended amount of time that it took to come into compliance had on the <br />surrounding properties which are all located within the Community Redevelopment <br />District. Commissioner Solomon stated she was not in favor of reducing the lien. <br />
