CASSI:JLBI;RRY CITY COMMISSION <br />Minutes of February 28, 2011-Regular Meeting <br />Page 5 of 11 <br />BEEN INTENTIONALLY DAMAGED; PROVIDING FOR SEVERABILITY, CODIFICATION, <br />CONFLICTS, AND EFFECTIVE DATE." <br />Notice of Public Hearing: The Notice of Public Hearing relative to Ordinance 11-1345 was published in the <br />Orlando Sentinel on February 17, 2011. <br />Staff Presentation: Ms. Sandra Smith, Chief Planner, stated Ordinance 11-1345 provides for amendments to <br />Section 3-14.8, Tree replacement requirements which will still require a permit for the removal of dead trees on <br />undeveloped commercial properties, but will allow an opportunity to obtain a waiver from replacement <br />requirements after a staff inspection of dead and diseased trees to verify conditions prior to removal. <br />Ordinance 11-1345 was approved on first reading on January 24, 2011. <br />Budget Impact: This amendment has the potential to impact the City's tree bank fund. <br />Recommendation: The City Manager and the Community Development Director recommended approval of <br />Ordinance 11-1345 on second and final reading. <br />Public Hearing: Mayor Glancy opened the public hearing relative to Ordinance 11-1345. No one came <br />forward. Mayor Glancy closed the public hearing relative to Ordinance 11-1345. <br />MOTION: Commissioner Solomon moved to approve Ordinance 11-1345, on second and <br />final reading, as presented. Motion was seconded by Commissioner Hufford. <br />Motion carried unanimously by voice vote 5 - 0. <br />B. First Readin:; of Ordinance 11-1346 - Seminola Boulevard Annexation Referendum <br />The City Clerk read Ordinance 11-1346 by title as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLROIDA, RELATING TO <br />ANNEXATION, MAKING LEGISLATIVE FINDINGS; ANNEXING TO AND INCLUDING WITHIN <br />THE CORPORATE LIMITS OF THE CITY OF CASSELBERRY, FLFORIDA, UPON ADOPTION <br />OF SAID ORDINANCE, CERTAIN LANDS LOCATED IN SECTION 08, TOWNSHIP 21, RANGE <br />30 AND SECTION 05, TOWNSHIP 21, RANGE 30; AN AREA LOCATED ALONG SEMINOLA <br />BOULEVARD LYING EAST OF UNITED STATES HIGHWAY 17-92; AS MORE PARTICULARLY <br />DESCRIBED HEREIN; PROVIDING FOR THE SUBMISSION OF THE QUESTION OF <br />ANNEXATION OF SAID LANDS INTO THE CITY OF CASSELBERRY AT A MAIL BALLOT <br />ELECTION WITH ALL BALLOTS DUE JUNE 14, 2011; PROVIDING FOR ADOPTION OF AN <br />URBAN SERVICES PLAN; PROVIDING FOR A BALLOT QUESTION; PROVIDING FOR <br />CANVASSING; PROVIDING FOR DIl2ECTIONS TO THE CLERK; PROVIDING FOR NON- <br />CODIFICATION, CONFLICTS, SEVERABILITY AND EFFECTIVE DATES." <br />Notice of Public Hearing: The Notice of Public Hearing relative to Ordinance 11-1346 was published in the <br />Orlando Sentinel on Febraary 17, 2011. Seminole County was officially notified via certified mail on February <br />1, 2011 of the proposed annexation.
