Reduction of Liens Reduest for 1153 Park Drive <br />Staff Presentation: Mr. Ketron Brown, Code Enforcement Supervisor, stated consideration to reduce code <br />enforcement liens placed on property located at 1153 Park Drive for case numbers CE-08-00617 ($13,400 - no <br />water service), CE-09-01115 ($675 -excessive glass and weeds), CE-09-03221($8,950 -trash and debris) and <br />CE-09-03222 ($9,250 -stagnant pool). During the time of the occurrence ofthe code violations, the property <br />owner, Abraham Machado, was incarcerated in the Seminole County j ail. The propelrty was in the foreclosure <br />process and a second properrty owner, Yanire Colon, had already abandoned the residence. The mortgage <br />holder on the propelrty was not able to correct the violation since the residence was an occupied homestead and <br />the foreclosure process had not been completed. Upon completion of the foreclosure, Robert Gillespie, the <br />petitioner and real estate agent for the mortgage holder, promptly corrected all pending code enforcement <br />violations and thel•e have not been any subsequent violations. A contract has been submitted for the sale of the <br />propelrty and Mr. Gillespie requested a waiver of the lien to facilitate the sale. The Code Enforcement Board <br />recommended to the City Commission a 50% reduction for each lien at its June 10, 2010 meeting, due to the <br />Petitioner addressing the violations as soon as he had the legal authority to do so. The necessary recording fees <br />have been paid and the other minimal administrative costs would be recouped as pat•t of the lien amount <br />received. The Code Enforcement Board's recommendation was based on several criteria provided for <br />consideration within the City Code, iiicludiug the gravity of the violation, the time it took to bl-ing the property <br />into compliance, the accrued amount of the lien, any previous or .subsequent code violations, or other <br />mitigating circumstances. A scoring sheet has been implemented for use by the Code Enforcement Board to <br />make their recommendations to the City Commission. The amended lien amount must be paid within sixty <br />days or the waiver becomes null and void, and the full amount becomes due. <br />Budget Impact: The lien amounts paid would be recognized in the City Budget as income received. <br />Recommendation: The City Manager and Community Development Director requested consideration of the <br />Code Enforcement Board's recommendation to reduce the liens by 50% to be paid within sixty days. <br />MOTION: Commissioner Doerner moved to reduce the lien for Code Enforcement case <br />
