Second Reading of Ordinance 10-1326 -Small Scale Future Land Use Map <br />Amendment for Property Located Near Cypress Way <br />The City Attorney read Ordinance 10-1326 by title as follows: <br />"AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, <br />TO AMEND THE CITY OF CASSELBERRY COMPREHENSIVE PLAN, BY AMENDING THE <br />FUTURE LAND USE MAP, ESTABLISHING THE FUTURE LAND USE MAP DESIGNATION OF <br />PUBLIC SERVICE (PS) FOR THE PARCEL AS DESCRIBED IN SECTION I OF THIS <br />ORDINANCE; PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE." <br />Notice of Public Hearing: The Notice of Public Hearing relative to Ordinance 10-1326 was published in the <br />Orlando Sentinel on June 3, 2010. <br />Staff Presentation: Ms. Sandra Smith, Chief Planner, stated Ordinance 10-1326 provides for an amendment <br />to the Future Land Use Map (FLUM) for a portion of Parcel ID #07-21-30-514-0000-0070 located near <br />Cypress Way, changing the classification from Medium Density Residential to Public Service. The propelrty <br />owner is requesting the amendment for the 9.428 acre parcel adjacent to the Evergreen Cemetery. The <br />Planning and Zoning Commission recommended approval of Ordinance 10-1326 at its March 10, 2010 <br />meeting. The City Commission approved Ordinance 10-1326 on first reading on April 12, 2010. Ms. Smith <br />stated the applicant has requested that the public hearing originally scheduled for June 14, 2010 be continued <br />in order to correct a minor error detected in the legal description of the subject area. The issue regarding the <br />legal description hs been resolved to the satisfaction of all propelrty owners. <br />Budget Impact: This item does not impact the City's Budget. <br />Recommendation: The City Manager and the Community Development Director recommended approval and <br />adoption of Ordinance 10-1326. <br />Public Hearing: The following individuals came foI•ward to address Ordinance 10-1326: <br />1) Mr. John Casselberty, 700 South Lost Lake Lane, voiced concerns regarding litigation history relating <br />to the subject property of Ordinance 10-1326 and its relation to the legal description issue. <br />2) Ms. Lilian Selph, 171 Quail Pond Circle, representative of Casselbeliy Investment Properties, spoke in <br />favor of Ordinance 10-1326. <br />No one else came forward. Mayor Glancy closed the public hearing relative to Ordinance 10-1326. <br />MOTION: Commissioner Doerner moved to approve Ordinance 10-1326 on second and <br />final reading, as presented. Motion was seconded by Vice Mayor Solomon. <br />Motion carl•ied unanimously by voice vote 5 - 0. <br />
