4. Design. Anon-traditional use shall be housed in a buildina that complies with the following <br />reaulations: <br />a. The buildina in which the use is located conforms to all current land development and <br />buildina reaulations. <br />b. The buildina shall be painted in muted colors and finished in materials that are consistent <br />and harmonious with the surrounding area and with the character of the Citv. <br />c. There shall be no security bars on the outside of doors or windows which are visible from a <br />public right-of-way. <br />d. Exterior phones and roll up doors shall be prohibited. <br />e. Windows shall not be obscured by the placement of signs. dark window tinting, shelving <br />racks or similar obstructions. <br />B. Hours of Operation. Non-traditional uses shall only operate between the hours of seven (7:001 <br />a.m. and eleven (11;00) p.m. <br />C. Maintenance, The buildina and site shall be maintained in a neat. clean, and orderly condition. <br />D. Signs. All signs shall be legally permitted in accordance with ULDR Article XVI. <br />*** <br />SECTION 3. That Section 5-21.2, Definition of terms, of Article XXI, Language and Definitions, <br />Chapter V, Glossary, Part III, Unified Land Development Regulations, of the Code of Ordinances of the City <br />of Casselberry, Florida shall be amended as follows: <br />*** <br />Body art establishment. A location where a licensed tattoo artist creates an indelible mark <br />graphic illustration, figure, or word upon a human bodv by the insertion of inks, dues or• pigments of <br />any kind in or under the skin or by producing scars. This term does not include those premises <br />where tattooin is performed by a person licensed to practice medicine or dentistry, and such <br />tattooing is incidental and subordinate to that person's practice of medicine or dentistry and <br />involves onl the camouflaging of scars or skin blemishes or the restoration of normal skin. The <br />service may be the puncturing or cutting of a part of the human bodv to create an opening in which <br />ewelry or an object may be worn. <br />*** <br />Non-traditional uses. A service use that reauires additional reaulations to ensure that the business <br />is in harmony with the goals and vision of the Citv. Non-traditional uses include bodv art <br />establishments. pawn shops, and check cashing and/or /payday loan businesses. <br />*** <br />Pawn shop. A business that offers monetary loans in exchange for an item of value that is given <br />to the pawn broker. If an item is pawned for a loan, within a certain contractual period of time the <br />pawner may purchase it back for the amount of the loan plus some agreed-upon amount for <br />interest. If the loan is not paid (or extended, if applicable) within the time period, the pawned item <br />will be offered for sale by the pawnbroker/secondhand dealer. <br />*** <br />Ordinance 10-1313 <br />Non-traditional Uses <br />Page 4 <br />
