4. Design. Anon-traditional use shall be housed in a buildina that complies with the following reaulations: a. The buildina in which the use is located conforms to all current land development and buildina reaulations. b. The buildina shall be painted in muted colors and finished in materials that are consistent and harmonious with the surrounding area and with the character of the Citv. c. There shall be no security bars on the outside of doors or windows which are visible from a public right-of-way. d. Exterior phones and roll up doors shall be prohibited. e. Windows shall not be obscured by the placement of signs. dark window tinting, shelving racks or similar obstructions. B. Hours of Operation. Non-traditional uses shall only operate between the hours of seven (7:001 a.m. and eleven (11;00) p.m. C. Maintenance, The buildina and site shall be maintained in a neat. clean, and orderly condition. D. Signs. All signs shall be legally permitted in accordance with ULDR Article XVI. *** SECTION 3. That Section 5-21.2, Definition of terms, of Article XXI, Language and Definitions, Chapter V, Glossary, Part III, Unified Land Development Regulations, of the Code of Ordinances of the City of Casselberry, Florida shall be amended as follows: *** Body art establishment. A location where a licensed tattoo artist creates an indelible mark graphic illustration, figure, or word upon a human bodv by the insertion of inks, dues or• pigments of any kind in or under the skin or by producing scars. This term does not include those premises where tattooin is performed by a person licensed to practice medicine or dentistry, and such tattooing is incidental and subordinate to that person's practice of medicine or dentistry and involves onl the camouflaging of scars or skin blemishes or the restoration of normal skin. The service may be the puncturing or cutting of a part of the human bodv to create an opening in which ewelry or an object may be worn. *** Non-traditional uses. A service use that reauires additional reaulations to ensure that the business is in harmony with the goals and vision of the Citv. Non-traditional uses include bodv art establishments. pawn shops, and check cashing and/or /payday loan businesses. *** Pawn shop. A business that offers monetary loans in exchange for an item of value that is given to the pawn broker. If an item is pawned for a loan, within a certain contractual period of time the pawner may purchase it back for the amount of the loan plus some agreed-upon amount for interest. If the loan is not paid (or extended, if applicable) within the time period, the pawned item will be offered for sale by the pawnbroker/secondhand dealer. *** Ordinance 10-1313 Non-traditional Uses Page 4
