CITY ®F CASSEI,~E Y <br />C®E ENF®12CEliiIE~T'I' ® IVIEET'II~G <br />I®1®VEIi~I~Ela 04, 2010 <br />Marlene Broman, Code Compliance Officer gave testimony for the above case. The City asked for a <br />compliance date of 11/19/2010 and a $100.00 per day fine if no compliance. The City also requested <br />abatement of the property if no compliance. <br />MOTIOI~T: Paul L. McKernan moved to find Respondents in CEB Case #10-02254 in violation of City <br />Code, Section 70-2(C) and that such violation constitutes a serious threat to the public health, safety and <br />welfare, and that Respondents shall correct the violation before 1:00 p.m., 11/18/2010. If Respondent (s) <br />fails to correct the violation by this date a fine in the amount of $100.00, per day will be imposed for each <br />and every day the violation continues beyond the date set for compliance. In addition, if there is no <br />compliance by this date, the Board requests that the City take appropriate action, if feasible, to accomplish <br />all reasonable repairs or provide all services necessary to bring the property into compliance and <br />Respondents will be charged with the cost of such repairs and services in addition to the fine imposed. A <br />Subsequent hearing will be held before this Board on 12/09/2010 to determine compliance by the aforestated <br />date. Nole Smith seconded the motion.
