ARTICLE 5 <br />GRIEVANCE PROCEDURE <br />5.1 The purpose of this Article is to establish machinery for the fair, expeditious, and orderly <br />adjustment of grievances regarding the interpretation or application of this Agreement, including <br />disciplinary actions. <br />5.2 Any formal grievance filed shall be in writing, shall set forth the provision or provisions of the <br />Agreement alleged to have been violated, the facts pertaining to the alleged violation(s), the date of <br />the violation, and the remedy requested. The grievance shall be signed and dated by the grievant. <br />Grievances submitted which do not contain the above information and are incomplete shall be <br />amended by the grievant to state the required information or the grievance will be invalid. <br />5.3 An employee who wishes to submit a grievance must submit a grievance in writing within ten <br />(10) working days after the occurrence of the matter from which the grievance arose. A grievance not <br />appealed to the next step within the time limits established by this procedure shall be considered <br />settled on the basis of the last answer provided by management. A grievance not answered within <br />the time limits prescribed for the appropriate management representative at each step shall <br />automatically be advanced to the next step except those grievances reaching or originating at Step <br />Two. The time limits in this Article may be extended by written mutual agreement of the panties. <br />5.4 In advancing grievances, the grievant, employee(s), and management may call a reasonable <br />number of witnesses to offer testimony. Either party may call witnesses as needed. Hearings shall be <br />continued to facilitate appearance of witnesses who are depat~tment employees and whose presence <br />would otherwise conflict department needs. <br />5.5 The formal grievance steps are as follows: <br />Step One <br />The employee(s) shall file the grievance, in writing, within ten (10) working days of the occurrence <br />of the event giving rise to the grievance of the matter to the department head. <br />The department head shall make a decision and communicate it to the employee and the Union in <br />writing within ten (10) working days from the date the grievance was received or conference held. <br /> <br />
