Board of Adjustrttenl <br />November 19, 2009 <br />page 7 <br />Ms. Gauvin asked if (here was anyone in the audience who wished to speak in favor of the request. Ms, Jean <br />Pangborn, 3168 Greenwood Street, Winter Park, Fiorjda came forward. Mr. Pangborn said she is the Chair of the <br />Homeowners' Association Architectural Review Board. She said both the Architectural Review Board and the <br />Homeowners' Association have reviewed the specifications for Mr. Summerhi[I's addition and unanimously approved the <br />request. Ms. Pangborn felt that Mr. Summerhill should have the enjoyment and enhancement to his property. <br />Ms. Terry Thompson, 3967 Greenwood Street, Winter Park, Florida came forward, Ms. Thompson said her <br />home had a Florida room when she purchased her home and if has withstood the hurricanes in 2004. She said she has <br />no objection to Mr. Summerhill's request. <br />Ms. Gauvin asked if there was anyone in the audience who wished to speak in opposition to the request. Igo one <br />came forward, <br />In response to the Board's question, Ms. Smith stated at the time the property was developed a 20 foot rear set <br />was required. A lengthy discussion ensued regarding the permitting of the existing screen rooms in the development, the <br />"blanket variance" far the adjacent townhomes for Phases 3 and 4 and the criteria necessary to grant a variance. <br />Ms. Gauvin asked for a motion for BA 09-05. Mr. McMullen made a motion to approve BA 09-05 variance <br />application for 3965 Greenwood Stree#, Casselberry, [=lorida. Mr. Armour seconded the motion, <br />The motion passed with a majority vote with Mr. Guzman casting the dissenting vote. <br />A discussion ensued regarding including the staff recommendations. Ms. Smith clarified the findings of the <br />motion to read: <br />Criteria No. 3; Granting the variance would nok confer any special privilege to the applicant which is <br />not already enjoyed by the property owners within this subdivision and the Phase 3 and 4 subdivision. <br />Criteria No. ~: Literal interpretation of the Land Development Regulations would deprive the applicant <br />of rights enjoyed by other properties within the same development. <br />Criteria Na 5: The variance granted is the minimum varjance that will make possible the reasonable <br />use of the land, building or structure. <br />Sixth ]tem of Business: Other Business <br />Ms. Smith stated that due to the holiday the next Board of Adjustment meeting is scheduled for December 17, <br />2009. Ms. Smith said based on the submittal of information from Mr. 5avino he could be scheduled for the December <br />meeting. <br />
