Board of Adjustment <br />November 19, 2Q49 <br />Page 6 <br />Fourth Item of Business: BA 09.05: 3965 Greenwood StreetlJason Rowland (Applicant) and Jimmie Summerhill <br />Owner , Variance requestto grant a variance to Article V,Section 2.5.4 "Size andDr`mension Criteria" and Table <br />2-5.4 of the Casselberry Unified Land Development Reaulakions to allowa 7 foot reduckion in the required 20 foot <br />rear building setback, <br />Ms. Sandra Smith, Chief Planner, reviewed Mr. Senzee`s memo dated November9, 2009 (a copyis on file in the <br />Community Development Department). Ms. Smith stated the variance application meets 3 of the 6 criteria for granting <br />the variance; therefore, City staff cannot fully support the request. She said if the Board of Adjustment chooses to grant <br />the variance requested for BA 09-05, for the proper#y located of 3965 Greenwood S#reef, to agow a 7 foot reduction in the <br />required 20 foot rear building setback, the motion should be based upon the Board of Adjustment's findings of fact and <br />conclusions, the proposed site pion (Exhibit B), and the following conditions: <br />1. The variance shall only pertain to the proposed addition shown in Exhibit B. <br />2. The addition shall meet all other site development criteria. <br />3. A building permit for the addition shall be obtained from the City's Building Safety Bureau withjn 60 <br />days of the approval by the Board of Adjustment and the certificate of completion shall be obtained <br />with 920 days of the issuance of the building permit. <br />4. All of the above conditions shat[ be fully and faithfully executed or the variance shall become null <br />and void. <br />In response to the Board's question, Ms. Smith explained that a screen enclosure has a screened roof and is <br />considered a temporary structure and an addition has a solid roof and is considered a permanent structure. A general <br />discussion ensued regarding the type of concrete slab required for an addition. Ms. Smith explained that the variance is <br />before the Board and the Building Department would determine what type of concrete slab is required for khe addition. <br />Ms. Gauvin asked the applicant to come forward. Mr. Jim Summerhill, 3165 Greenwood, Gasselberry, Florida <br />came forward. Mr. Summerhill stated he purchased the home as his retirement home, He said that there are 12 homes <br />on his street that have structures similar to whale he is requesting. He said he has no privacy in his backyard and the solid <br />roof would provide privacy from the adjacent two story buildings. He said he is proposing an addition with a solid roof <br />with vinyl type windows to prevent the rain from coming into the room. <br />Mr. Larry Brace, 3005 Forsyth Raad, Winter Park, Florida came forward. Mr. Brace said he has over 25 years <br />experience in residential construction. In response to khe Board's question, Mr. Brace stated that the existing concrete <br />slab is sufficient to support the screen room with a hard roof and vinyl windows. <br />
