Planning & Zoning Commissionl <br />Local Planning Agency <br />June 23, 2010 <br />Page 5 <br />are the only two reasons that a waiver could be granted under the City Code. She said as to what has happened in <br />the past we don't know why waivers were granted. Ms. Drage stated the Commission has the option to grant a <br />continuance to allow for the recalculation of the tree bank contribution. <br />A general discussion ensued regarding the liability associated with the dead trees and the permitting <br />process for removal of dead trees. Mr. Anderson stated that in the past he received notification from Code <br />Enforcement stating that he had a dead tree on his property that was endangering the adjacent property and the tree <br />must be removed or the City would remove the tree at his expense. He also stated that an adjacent property owner <br />requested he remove a dead tree that was hanging over their property. <br />Ms. Drage stated that the public portion of the meeting has been closed and suggested that the meeting be <br />reopened for public comment or refrain from having continued comments from the applicant, Mr. Parkhurst reopened <br />the public portion of the meeting. Mr. John Casselberry, 700 South Lost Lake Lane, Casselberry, Florida came <br />forward. Mr. Casselberry said he doesn't understand the tree bank because he doesn't know what right the City has <br />financially for trees that are on private property. He said he is a big fan of trees. Mr. Casselberry said if the tree <br />requirements are too unreasonable it will discourage people from planting trees. <br />A general discussion ensued regarding the tree bank requirements, providing a continuance to allow the <br />applicant time to provide more information regarding the size of the trees that were removed, fining property owners <br />for removal of trees and the site plan review process for modifications. Ms. Drage stated that the site plan review <br />process uses a checklist to determine if the applicant meets the criteria as defined in the code. She explained that <br />tonight's item is not a fine but a requirement for tree replacement and the applicant is requesting a waiver from the <br />City Code requirements for replacement of the trees that were removed from the site, Ms. Smith stated that the <br />Planning and Zoning Commission has provided modifications to a site plan allowing a reduction in the number of <br />parking spaces to accommodate a large tree. Ms. Smith explained that the City through the City Commission <br />provided a development incentive to Mr. Wilson to eliminate the cost for the tree replacement and a development <br />order was executed. <br />
