Planning & Zoning Commissionl <br />Local Planning Agency <br />June 23,2010 <br />Page 3 <br />based on the Planning and Zoning Commission's findings of fact and conclusions of the staff report dated June 17, <br />2010 and the following conditions: <br />1. The applicant is exempt from tree replacement requirements for 412" (dbh). <br />2. All future development will require additional site plan review by City Staff and the Planning and Zoning <br />Commission. <br />3. No further site engineering construction activities shall take place at the site until permits are issued by <br />the City's Public Works Department. <br />4. All permits from appropriate State and County agencies shall be obtained prior to the submittal for a site <br />engineering permit to the City's Public Works Department. <br />Mr. Raasch stated that the Planning and Zoning Commission's denial of SPR 10-07, for a tree removal <br />permit and a waiver from replacement requirements for the property located at 95 Concord Drive, would be based on <br />the findings of fact and conclusions of the staff report dated June 17, 2010 and the following conditions: <br />1. The applicant shall submit a restoration plan for staff review. The restoration plan may be accompanied <br />by a detailed site survey by a certified arborist, which indicates the exact species and size of each tree <br />that was illegally removed, <br />2. The applicant shall provide either an additional 55 canopy trees on site or contribute $96,415 to the <br />Casselberry Tree Bank by December 23, 2010. <br />3. Should the applicant choose to plant the trees on the site, the trees shall have minimum sizes (dbh) as <br />indicated in Table 1. The applicant may also coordinate with staff in order to provide additional <br />materials on site in order to reduce the required contribution. <br />4. All future development will require site plan review by City Staff and the Planning and Zoning <br />Commission, <br />5. No further site engineering construction activities shall take place at the site until permits are issued by <br />the City's Public Works Department, <br />6. All permits from appropriate State and County agencies shall be obtained prior to the submittal for a site <br />engineering permit to the City's Public Works Department. <br />7. All of the above conditions shall be fully and faithfully executed or the landscape restoration plan shall <br />become null and void and full payment to the City Tree Bank in the amount of $96,415 will be required <br />within three months of making this determination. <br />A general discussion ensued regarding the measurement of the stumps, condition of the stumps and the <br />arborist's letter that was included in the staff report as Exhibit D. Ms. Smith stated that the Public Works Department <br />has certified arborists on staff; however, due to their schedules they do not have the ability to make inspections for <br />staff. <br />Mr. Parkhurst asked the applicant to come forward. Mr. Mike Anderson, 105 Roann Drive, Oviedo, Florida <br />came forward, Mr. Anderson stated that his property was put on the market in December, He said when he walked <br />
