Mr. Senzee provided an aerial in the PowerPoint presentation that may more accurately depict the <br />location of the proposed dock. <br />Mr. Senzee stated Staff finds that the proposed use is compatible with the surrounding land uses; however, <br />staff requests that the dock be shortened in order to better match the surrounding docks. He said if the Planning and <br />Zoning Commission chooses to approve CU 10-02 to allow a private residential dock at 191 South Triplet Lake Drive, <br />the motion should be based on the staff report dated April 8, 2010, the site drawing attached to the staff report as <br />Exhibit B, the Planning and Zoning Commission's findings of fact, and the conditions outlined in the staff report which <br />are: <br />1. The conditional use shall be limited to the proposed dock structure. The dock shall not be enlarged or <br />enhanced in any way without additional conditional use approval by the Planning and Zoning <br />Commission <br />2. The construction and maintenance of the dock shall be in accordance with the requirements of all <br />applicable state agencies and the City's ULDR. <br />3. The applicant shall incorporate dock lighting into the plans prior to submitting for a building permit. This <br />lighting shall illuminate the entire length of the dock as required by Section 94-6. <br />4. A building permit for the dock shall be obtained within 60 days of the approval and a final inspection <br />shall be obtained within 120 days of the issuance of the building permit. <br />5. All of the above conditions shall be fully and faithfully executed or the conditional use shall become null <br />and void. <br />A brief discussion ensued regarding the length of the dock, filling in the cove area and the construction of <br />docks for the adjacent properties. Mr. Parkhurst asked the applicant to come forward. Mr. Mark Reisinger, 191 <br />South Triplet Lake Drive, Casselberry, Florida came forward. Mr. Reisinger stated that the 2004 aerial view of his <br />property shows that his land extended out to the City's proposed location for the dock as shown on the aerial in the <br />staff report. He said that a previous property owner obtained a permit to modify the lake line and the lake is very <br />shallow with a lot of muck. Mr. Reisinger stated that his proposed dock would not conflict with construction of docks <br />for the adjacent properties because the lots are not pie shaped. Mr. Reisinger said that he is concerned that he <br />would not be able to use the dock during the dry season. <br />Mr. Parkhurst asked if there was anyone in the audience who wished to speak in favor of, or in opposition <br />to, the request. Mr. John Casselberry, 700 South Lost Lake Lane, Casselberry, Florida came forward. Mr. <br />Casselberry felt that the extensive length of the dock could become a liability issue. <br />
