SECTION 2. Authority. This Ordinance is adopted in compliance with, and pursuant to, <br />the Local Government Comprehensive Planning and Land Development Regulations Act, Section <br />163.3184 and 163.3187, Florida Statutes. <br />SECTION 3. Those portions of the Future Land Use Element that reference concurrency <br />management systems are eliminated and those portions that reference the "US Hwy 17-92 <br />TCEA" transit strategies are amended to apply to the City of Casselberry as a whole. Minor <br />amendments are provided to eliminate reference to the "properties within the TCEA" because <br />now all properties are within the TCEA. The Executive Summary is also amended to reflect the <br />citywide TCEA. The edits within the Future Land Use Element are provided in "Exhibit A", a copy <br />of which is attached and by this reference incorporated and hereby adopted pursuant to Florida <br />Statutes. <br />SECTION 4. Those portions of the Traffic Circulation Element that reference service <br />standards based on a concurrency management system are qualified by new language to state <br />that the levels of service are "provided for planning and evaluation" to help determine whether <br />policies for mobility are being met, the requirements for a Traffic Impact Analysis (TIA) are <br />maintained, and a statement upholding the imposition of traffic impact fees is provided. Several <br />edits are provided throughout the element that eliminates reference to the previously adopted <br />TCEA and language is provided to indicate the TCEA is applied to the entire City of Casselberry. <br />The "TCEA Boundary map" is amended to eliminate the US Hwy 17-92 Corridor TCEA and show <br />the TCEA applied to the entire city. The "TCEA Boundary Map" is deleted in its entirety. The <br />edits within the Traffic Circulation Element are provided in "Exhibit B", a copy of which is attached <br />and by this reference incorporated and hereby adopted pursuant to Florida Statutes. <br />SECTION 5. The portion of the Capital Improvement Element that references traffic <br />circulation levels of service was applied to use for planning and evaluation of the city's mobility <br />strategies.
