First Reading of Ordinance 10-1328 - "Mark Wandall Traffic Safety <br />The City Clerk read Ordinance 10-1328 by title as follows: <br />"AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA <br />AMENDING THE CITY CODE BY AMENDING CHAPTER 82, TRAFFIC AND VEHICLES, <br />ARTICLE VIII, "AUTOMATED RED LIGHT ENFORCEMENT"; PROVIDING FOR RECORDED <br />IMAGE MONITORING AND ENFORCEMENT OF RED LIGHT TRAFFIC CONTROL SIGNALS <br />CONSISTENT WITH GENERAL LAW AS PROVIDED BY CHAPTER 2010-80, LAWS OF <br />FLROIDA (2010); PROVIDING FOR CONFLICTS, SEVERABILITY, CODIFICATION; <br />PROVIDING FOR SAVINGS, RATIFICATION AND RESERVATION OF RIGHTS; PROVIDING <br />FOR AN EFFECTIVE DATE." <br />Staff Presentation: Interim Police ChiefBill McNeil stated Ordinance 10-1328 provides amendments to the <br />Automated Red Light Enforcement section of the code to conform with and implement Chapter 2010-80 Laws <br />of Florida (2010), the "Mark Wandall Traffic Safety Act". The new legislation goes into effect July 1, 2010 <br />and Ordinance 10-1328 provides the transition from the City's current program by specifically providing that <br />the procedural matters relating to notices of infraction issued by the City on or before June 30, 2010 shall <br />remain in effect to preserve the rights of recipients of the notices and the City beyond the implementation of <br />the State program. The new laws provide a $158 fine and the City's portion of the revenue will be $75.00. <br />This will necessitate an amended agreement with the current vendor, American Traffic Solution which will be <br />presented to the City Commission for consideration at a fuhu•e meeting. <br />Budget Impact: There is no impact to the City's Budget. <br />Recommendation: The City Manager and the Interim Police Chief recommended approval of Ordinance 10- <br />1328 on first reading. <br />Audience Participation: The following individuals came forward and addressed Ordinance 10-1328: <br />1) MI•. James Fraleigh, 1290 Seminola Boulevard, spoke in opposition to Ordinance 10-1328. <br />2) Mr. Craig Tull, 420 Ranch Trail, spoke in opposition to Ordinance 10-1328. <br />3) Mr. John Casselberly, 700 South Lost Lake Lane, spoke in favor of Ordinance 10-1328. <br />
