Fil•st Reading of Ordinance 10-1331- ULDR Amendment to Section 2-7.10 -Fences <br />and Walls Related to Fence Maintenance in Residential Districts <br />The City Clerk read Ordinance 10-1331 by title as follows: <br />"AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, <br />AMENDING THE CITY OF CASSELBERRRY, FLORIDA, CODE OF ORDINANCES, PART III, <br />UNIFIED LAND DEVELOPMENT REGULATIONS, CHAPTER II, DISTRICT AND GENERAL <br />REGULATIONS TO AMEND ARTICLE VH, SECTION 2-7.10 FENCES AND WALLS TO <br />INCLUDE REGULATIONS PERMITTING THE RECONSTRUCTION AND REPAIl2 OF <br />LEGALLY EXISTING NON-COMPLIANT FENCES AND WALLS IN RESIDENTIAL DISTRICTS; <br />PROVIDING FOR CODIFICATION, CONFLICTS, SEVERABILITY, AND AN EFFECTIVE <br />DATE." (LPA 10-OS) <br />Notice of Public Hearing: The Notice of Public Hearing relative to Ordinance 10-1331 was published in the <br />Orlando Sentinel on June 3, 2010. <br />Staff Presentation: Ms. Sandra Smith, Chief Planner, stated Ordinance 10-1331 provides for amendments to <br />the Unified Land Development Regulations to allow the replacement of legally existing non-compliant fences <br />and walls. A fence or wall is determined to legally exist if a building permit was issued for its construction. <br />The Planning and Zoning Commission recommended approval of Ordinance 10-1331 at its May 12, 2010 <br />meeting. <br />Budget Impact: This item does not impact the City's Budget. <br />Recommendation: The City Manager and the Community Development Director recommended approval of <br />Ordinance 10-1331 on first reading. <br />Public Hearing: The following individuals came forward to address Ordinance 10-1331: <br />1) Mr. Craig Tull, 420 Ranch Trail, voiced concerns regarding disclosure of permitting relating to real <br />estate transactions and change of ownership. It was clarified that permits run with the land and change <br />of ownership does not affect existing peI•mits. <br />2) Ms. James Fraleigh, 1290 Seminola Boulevard, spoke in opposition to Ordinance 10-1331. <br />No one else came folward. Mayor Glancy closed the public hearing relative to Ordinance 10-1331. <br />MOTION: Commissioner Doernel• moved to approve Ordinance 10-1331 on first reading, <br />as presented. Motion was seconded by Vice Mayor Solomon. <br />DISCUSSION: Commissioner Doerner, Commissioner Hufford and Vice Mayor Solomon spoke in <br />favor of Ordinance 10-1331. <br />Motion carried unanimously by voice vote 5 - 0. <br />
