WHEREAS, the City Commission hereby finds that parking in an organized manner in the front, <br />side and rear yards is necessary to preserve the residential character, integrity, and unique aesthetic <br />qualities of neighborhoods within the City of Casselberry; and <br />WHEREAS, neighborhood aesthetics are an integral part of maintaining property values and are relevant <br />zoning considerations. See Wood, 305 So. 2d. 261; and <br />WHEREAS, the City desires to require vehicles parked in the residential district to be operational and <br />properly licensed or garaged; and <br />WHEREAS, this ordinance does not affect the requirements for on-street parking provided in Chapter 82 of <br />the City Code; and <br />WHEREAS, the City Commission of the City of Casselberry held a duly noticed public hearing on the <br />proposed changes set forth herein and hereby finds this Ordinance to be in the best interests of the public health, <br />safety, and welfare of the citizens of the City of Casselberry and to be consistent with the City of Casselberry's <br />Comprehensive Plan. <br />NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, <br />FLORIDA: <br />SECTION 1: The Code of Ordinances of the City of Casselberry Part III, Article X, Section 3-10.9, Parking <br />of vehicles in residential districts, is hereby deleted in its entirety and replaced with the following text: <br />Section 3-10.9. Parking of vehicles in residential districts. <br />The parking of prohibited vehicles, permitted vehicles, and recreational equipment in residential districts shall be <br />regulated as follows: <br />A. Prohibited Vehicles. The following vehicles are prohibited from parking in all residential districts, including the <br />right-of-way, unless the vehicle is parked in accordance with the criteria provided in this Section and the vehicle <br />is in the process of making deliveries, or is actively engaged in service work. These requirements do not include <br />recreational equipment. <br />1. Any vehicle greater than twenty- two (22) feet in length, including attachments. <br />2. Any vehicle greater than eight (8) feet in height, including attachments. <br />3. Vehicles and equipment, including but not limited to: farm, grading or industrial equipment; step vans; stake- <br />bed trucks; flatbed trucks; non-recreational utility trailers equal to or greater than twenty-five (25) feet in <br />length, including hitches; dump trucks; trucks without a bed; buses; tractor cabs; tractor trailers; wreckers; <br />hearses; tow dollies; vehicles with three or more axles; utility bed trucks; trucks of any size which have <br />operating motorized cooling units; and trucks with scrolling signs. <br />B.
