Resolution 10-2106 -Florida Department of Transportation Subordination of Utility <br />Interests Agreement Re a~~ the Red Buy; Lake Road Flyover Project <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE <br />EXECUTION OF A SUBORDINATION OF CITY UTII.ITY INTERESTS AGREEMENT BETWEEN <br />THE CITY OF CASSELBERRY AND THE FLORIDA DEPARTMENT OF TRANSPORTATION <br />(FDOT); PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." <br />Introduction: Resolution 10-2106 provides for a Subordination of City Utilities Irerests Agreement for <br />FDOT Parcel No. 101.14, in conjunction with the Red Bug Lake Road Flyover Project. <br />Budget Impact: This item has no impact to the budget. <br />Recommendation: The City Manager and the Public Works Director recommended approval of Resolution <br />10-2106. <br />MOTION: Commissioner Millel• moved to approve the Consent Agenda as presented. <br />Motion was seconded by Vice Mayol• Solomon. Motion carried unanimously by <br />voice vote 5 - 0. <br />9. PUBLIC HEARINGS <br />No Public Hearings were scheduled for this meeting. <br />10. FIRST READING F O IANCES <br />A. First Reading of Ordinance 10-1311 -Franchise Agreement with Waste Pro of <br />Florida, Inc. for Residential Solid Waste Collection Services <br />The City Clerk read Ordinance 10-1311 by title as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE <br />EXECUTION OF A COOPERATIVE PURCHASE FRANCHISE AGREEMENT WITH WASTE <br />PRO OF FLORIDA, INC., FOR RESIDENTIAL SOLID WASTE COLLECTION SERVICES; <br />PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." <br />Staff Presentation: Mr. Ed Torres, Public Works Director, stated Ordinance 10-1311 provides for a <br />cooperative purchase Franchise Agreement with Waste Pro of Florida, Inc, for residential solid waste collection <br />services. The agreement is a piggyback to the Seminole County Agreement with Waste Pro and will begin <br />April 1, 2010 for a period of eight years (expiring March 31, 2018), with an option to extend the conh•act up to <br />an additional five years if mutually agreed upon. The new agreement entitles Waste Pro to an adjustment once <br />a year based on the previous year's consumer price index. The fuel component is calculated differently in the <br />
