Change condition No. t3: The maximum average length of stay shall not exceed three nine <br />months, <br />Mr. Aramendia`s motion resulted in the following conditions of approval <br />~. `the proposed use shall be limited to "Unit 3Bn as identified on the site plan and the areas provided within <br />the °Access and Space Use Agreement" (Exhibit G) executed between Pathways to Care and Pathways to <br />Independence. This agreement mus# be signed and recorded prior to issuance of a building permit, <br />~. >;xecution and recordin of the "Use. Access & Utifitv_Aar_ee~ent" (Exhibit ill far a portion of Unit 2 to <br />accommodate the landscape improvements is required priarto issuance of a ~uildfna permitpermit. <br />2. The City of Casselberry Development Order, attached to this staff report as Exhibit B, shall be executed <br />prior to issuance of a building permit. The Development Order shall be amended as follows: <br />a. Add paragraph {x) -- The maximum average length of stay at the facility shall not exceed nine <br />months, <br />b. The primary use of the property is to be as a convalescent care facility provided to the elderly or infirmed as <br />defined in the development order. <br />~. The design and operation of the structure must adhere to the requirements of all regulatory agencies, the <br />Florida 13uifding Code, NFPA, and City of Casselberry Public Works Department, Building Division and Fire <br />Marshal. <br />b. A maximum of ten bedrooms with a maximum twenty beds total shall be provided. <br />6. Outpatient services are to include physical rehabilitation and occupational therapy. The outpatient services <br />will be extended only to those persons who were convalescent patien#s of the facility. <br />7. The maximum average length of stay shall not exceed three ~ months. <br />8. All business tax receipts, permits, certifications and inspections by the City of Casse[berry, Seminole County <br />and the State of Ffarida and any other regulatory agencies shalt be obtained, completed and kept current at <br />all times, or the conditional use shall become Wulf and void. <br />9. The oporatfon of the convalescent care facility shalt begin within twelve months of the conditional use <br />approval. <br />10, If the convalescent care facility changes names or ownership, a new conditional use application review shall <br />be required within sixty {60) days of the change. <br />T 1. If the convalescent care facility ceases operations for a period of ninety (90) days or mare, the conditional <br />use shall become Huff and void. <br />~2.
