Planning & Zoning Commission) <br />Local Planning Agency <br />February 24, 2010 <br />Page 10 <br />Mr, Qavid Smith, Aloma Baptist Church, 1815 State Road 436, Winter Park, Florida came forward. Mr. <br />Smith encourage the Commission to find ways to accommodate the concerns raised tonight but also accommodate <br />the property owners that see it as an opportunity far future expansion, Mr. Smith felt that Phis could be profitable and <br />beneficial but also needs to be sensitive to the residents. <br />Mr. Borivoje Radulovic,1070 State Road 436, Winter Park, Florida came forward in favor of the request. Mr. <br />Radu[ovic stated he owns lot 13 and he is limited by the restrictive zoning. He said his property is underutilized. <br />Ms. Smith explained that Phis is a large scale comprehensive plan amendment that would be reviewed by <br />the Department of Community Affairs (QCA), the Department of Transportation, St, Johns River Water Management <br />District, Bast Central Florida Regional Planning Council as well as three or four other agencies, She said any <br />development that occurs within the PMX-High or PMX-Mid would be required to meet the design standards that will <br />be developed to accommodate these properties. <br />A general discussion ensued regarding excluding Lo# 10 and Lot 16 from the amendment packet. <br />Ms. Smith said a comment was made that the City Commission would review requests to rebuild if a <br />property is damaged more than 50%. She explained that the Board of Adjustment would be responsible to review <br />those requests. She said this is an opportunity to provide development within the City of Casselberry. She said it <br />would attract new businesses by allowing these sites to be developed to their fullest potential. She said that property <br />owners have the ability to be excluded from the amendment packet, She said the commercial property owners are <br />very much in favor of these proposed future land use amendments. <br />Ms, Reischmann clarifed that the law does provide that non-conformities can essentially exist if they are not <br />enlarged and if they are not destroyed, She said as fang as the owner is actively seeking the same type of tenant <br />that was in the business at the time, the use can continue, <br />In response to Mr. Aramendia's previous request to exclude Lot 16 from the amendment packet, Ms. Smith <br />said there has been a request that Lot 16 not be excluded from this amendment packet. She said it is a fully <br />developed commercial site that is currently far sale. <br />
