Provide mulch and landscape limbers as a minimum requirement for pervious materials within the <br />drivewayldesignated parking area. <br />Mr. Van Meter seconded the motion. <br />The Board was polled. <br />Anthony Aramendia Yes <br />Nathan Van Meter Yes <br />Marlene Hyde Yes <br />Worley Parkhurst Yes <br />Daniel Wale Yes <br />Victor Lutz Yes <br />The motion passed unanimously. <br />Tenth Item of Business: ZB 09.10: Business Uses, Public Wearing for proposed amendments to various <br />portions of the Unified Land llevelopment Regulations (Ul_DR) regulating business uses including pawn <br />shops, tattoo parlors, body piercing salons, and used vehicle sales. <br />Ms. Sandra Smith, Chief Planner, reviewed the information provided in her memorandum dated January 5, <br />2010 and Exhibit B that was emailed to the Planning and Zoning Commission (copies are on file in the Community <br />Development Department). Ms. Smith explained that the City Commission imposed a moratorium on these <br />businesses uses to determine whether or not legislation is needed to control their proliferation. Ms. Smith said based <br />on the advice of the City Attorney new vehicle sales were also included with used vehicle sales. <br />Ms, Smith stated she separated vehicular sales into two categories: 1. vehicular sales -new vehicles and <br />2. vehicular sales--used vehicles with a'/z acre minimum site size. Ms, Smith stated the City Attorney has advised <br />that the City could be challenged by separating the two types of vehicle sales and requiring only a minimum site size <br />for used car sales. <br />Ms. Smith requested the Commission provide a public hearing and provide staff with direction regarding this <br />particular draft ordinance. In response to the Commission's question, Ms. Drage said the Commission must keep in <br />mind a factual basis for distinguishing between specific types of businesses with other businesses within the Gity. <br />
