Motion was seconded by Commissioner <br />Hufford. Motion carried unanimously by voice vote 5 - 0. <br />B. Resolution 10-2110 -First Amendment to Construction Fundin~Agreement with the <br />Florida Department of Environmental Protection for American Recovery and <br />Reinvestment Act <br />The City Clerk read Resolution 10-2110 by title as follows: <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE <br />EXECUTION OF THE FIItST AMENDMENT TO THE FLORIDA DEPARTMENT OF <br />ENVIRONMENTAL PROTECTION (FDEP) DII2NKING WATER STATE REVOLVING FUND <br />CONSTRUCTION LOAN AGREEMENT FOR THE CITY'S WATER QUALITY IMPROVEMENT <br />PROJECTS; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." <br />Staff Presentation: Mr. Ed Torres, Public Works Director, stated Resolution 10-2110 provides for the first <br />amendment to the Construction Funding Agreement with the Florida Department of Environmental Protection <br />for American Recovery and Reinvestment Act Funds for construction of water quality improvement projects <br />within the City's potable water distribution system. <br />Budget Impact: This amendment will reflect the construction administration and inspection services that <br />FDEP can fund based on Federal criteria. Any necessary funds beyond the $276,050 will have to be covered <br />by the City. It is estimated that an additional $46,950 will be required to fund construction administration and <br />inspection services not covered FDEP. The Public Works Renewal and Replacement Water Line Replacement <br />Account No. 402-0751-536.63-44, which has been funded at $300,000 per year, can be used and is hereby <br />recommended to fund the services not covered by FDEP. Please note that $310,000 is currently scheduled in <br />the FY 09/10 Public Works Renewal and Replacement Water Line Replacement Account and will be applied <br />toward repayment of the $450,000 loan portion of the funding agreement. $300,000 is also planned for <br />scheduling in the FY 10/11 account and can be used to pay the remaining $140,000 ofthe $450,000 loan. This <br />leaves a balance of $160,000 in FY 10/11 to address the $46,950 for construction administration and <br />inspection services not covered by the funding agreement as well as any additional construction. <br />Recommendation: The City Manager and the Public Works Director recommended approval of Resolution <br />10-2110. <br />
