Mr. Senzee said since the completion of the staff report, the applicant notified <br /> <br /> <br />survey drawing is incorrect. He said the applicant does not intend to add <br /> <br />additional <br /> <br /> <br />surface area to <br /> <br />property; therefore, the proposed addition will not exceed the area of the <br /> <br />Mr. Senzee said, <br /> <br />on <br /> <br />information, the applicant is proposing a 147 square foot addition with an 8 foot rear yard <br /> <br />requested 6 foot setback. Mr. Senzee requested that condition number 1 <br /> <br /> <br />to <br /> <br />The variance shall amy pertain to the <br />Board of Adjustment meeting. <br /> <br />addition as shown in Exhibit B presented at <br /> <br /> <br />Mr. Senzee said he has reviewed the setback variances for Brittany Garden <br /> <br /> <br />seven variance <br /> <br />requests for Brittany Gardens, he said that of seven variances were approved (a <br /> <br /> <br />requested <br /> <br /> <br />information is attached and made a part of the minutes). He said the denied variance <br /> <br /> <br />surface increase which raised the lot to approximately 80% impervious surface instead <br /> <br /> <br />maximum <br /> <br />Code. Mr. Senzee said based on the previous variance approvals, he would like to modify <br /> <br /> <br />on <br /> <br /> <br />3 to show that it meets the requirements since a clear precedent of setback <br /> <br />seems to <br /> <br />been established <br /> <br />the overall development. <br /> <br />Mr. Senzee stated the variance application meets 2 of the 6 criteria <br /> <br /> <br />cannot support the request. He said if the Board of Adjustment chooses to grant variance <br /> <br />SA <br /> <br /> <br />property located at 2691 Ultra Vista Drive, to allow a 7-foot encroachment a <br /> <br />rear <br /> <br />building <br /> <br />creating an 8-foot rear yard in lieu of the required 15-foot rear <br /> <br />the motion should based upon the <br /> <br />of <br /> <br />Adjustment's findings of fact and conclusions, the property <br /> <br />plan attached to <br /> <br /> <br />report, and the <br /> <br />outlined in the staff report including the modification to condition no. 1 <br /> <br />following is a list of the <br /> <br />of <br /> <br />approval: <br /> <br />1. The variance shall amy pertain to proposed addition as shown in Exhibit B at <br />2008 Board of Adjustment meeting. <br />2. The applicant shall obtain approval from Home Association to the of a <br />permit for the addition. <br />3. The addition must match the material, design, and color house. <br />4. The addition must adhere to all other applicable codes and regulations; including <br />area requirements. <br />5. A building permit for the addition shall be obtained from the <br />days of the approval by the Board of Adjustment and certificate of <br />within 120 days of the issuance of the building permit. <br />6. All of the above conditions shall be fully and faithfully executed or shall null and <br /> <br /> <br />
