<br />WHEREAS, Article XIV, Tree Protection, Section 3-14.15, Waivers and appeals, needs to <br /> <br />be corrected due to a scrivener's error and to clarify the intent; and <br /> <br />WHEREAS, Article XIV, Tree Protection, Section 3-14.16, Remedial action, a deadline <br /> <br />should be specified; and <br /> <br />WHEREAS, Article XIV, Tree Protections, Section 3-14.18, Establishment of City Tree <br /> <br />Advisory Committee (CTAC), provides responsibilities to the Parks and Recreation Department <br /> <br />and the City has eliminated this department, and <br /> <br />WHEREAS, words with double underlined type shall constitute additions to the original text <br /> <br />and strike tl1F8~~h shall constitute deletions to the original text. <br /> <br />NOW THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION 1. The foregoing whereas clauses are incorporated herein as legislative <br /> <br />findings by this reference and made a part hereof for all intents and purposes. <br /> <br />SECTION 2: The Code of Ordinances for the City of Casselberry Part III, Unified Land <br /> <br />Development Regulations, Chapter III, Performance Criteria, Article XIII, Landscaping, subsection <br /> <br />5 of Section 3-13.7, Other general landscape regulations, is hereby amended as follows: <br /> <br />Section 3-13.7. Other general landscape regulations. <br /> <br />The following general regulations shall apply to all landscaped areas: <br /> <br />** * <br /> <br />5. Credit forexisfing frees. Credit shall be granted for trees which are preserved on a <br />site and which meet the tree requirements of any landscaping provision of this Section. <br />Where a tree is of value to the site, eXGeptisnal q~ality, as determined by a qualified <br />landscape professional, the Planning and Zoning Commission shall grant a twe tree <br />an inch for inch credit for the preserved tree based on the retained tree's diameter at <br />breast heiaht IDBH). A valuable tree EXGe~tiGRal ~~ality shall be ~ determined <br />on the basis of such factors as extraordinary size of tree, vigorous health, large <br />canopy cover, historic value, rareness, and age.
