<br />ORDINANCE 09-1293 <br /> <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING <br />SELECTED SECTIONS OF THE CITY CODE OF ORDINANCES, PART III, <br />UNIFIED LAND DEVELOPMENT REGULATIONS, CHAPTER III, <br />PERFORMANCE CRITERIA; AMENDING ARTICLE XIII, LANDSCAPING, <br />SECTION 3-13.7, OTHER GENERAL LANDSCAPE REGULATIONS; <br />AMENDING ARTICLE XIII, LANDSCAPING, SECTION 3-13.8, <br />SPECIFICATIONS FOR PLANT MATERIALS; AND VARIOUS SECTIONS OF <br />ARTICLE XIV, TREE PROTECTION TO PROVIDE CRITERIA FOR <br />ESTABLISHING TREE VALUE, AND TO MAKE OTHER CLARIFICATIONS <br />AND CORRECTIONS; PROVIDING FOR SEVERABILITY, CODIFICATION, <br />CONFLICTS, AND EFFECTIVE DATE. <br /> <br />WHEREAS, Part III, Unified Land Development Regulations, of the Code of <br /> <br />Ordinances of the City of Casselberry was adopted by Ordinance No. 757 by the Casselberry City <br /> <br />Commission on March 1,1993 with a March 1. 1993 effective date; and <br /> <br />WHEREAS, Article XIII, Landscaping, provides criteria within Section 3-13.7, Other <br /> <br />general landscape regulations, to allow credit for existing trees at a rate of one tree retained equals <br /> <br />one tree credit; and <br /> <br />WHEREAS, a more reasonable approach is to allow a credit for the total inches retained <br /> <br />based on the trees diameter at breast height (DBH); and <br /> <br />WHEREAS, Article XIII, Landscaping, Section 3-13.8, Specifications for plant material, <br /> <br />provides a minimum tree height but does not provide a minimum tree trunk diameter; and <br /> <br />WHEREAS, Article XIV, Tree Protection, Section 3-14.6, Criteria for issuance of permits, <br /> <br />authorizes the Planning and Zoning Commission to approve tree removal permits, but this is a staff <br /> <br />level responsibility; and <br /> <br />WHEREAS, Article XIV, Tree Protection, Section 3-14.8, Tree Replacement <br /> <br />Requirements, provides the criteria to determine the value of a replacement tree, and this criteria <br /> <br />requires clarification; and <br />
