<br />J. Proportionate Share MitiQation. In the event there is not available school <br />caoacity to support a develooment. the School Board may entertain orooortionate <br />share mitiaation options and. if accepted. shall enter into an enforceable and <br />bindina aareement with the developer to mitiaate the impact from the <br />development throuah the creation of additional school capacity. <br /> <br />.!, When the anticipated student impacts from a proposed development <br />cause the adopted lOS to be exceeded. the developer's proportionate <br />share will be based on the number of additional student stations <br />necessary to achieve the established lOS. The amount to be paid will be <br />calculated bv the cost per student station for elementarv. middle and hiah <br />school as determined and published bv the State of Florida. <br /> <br />2. The methodoloQY used to calculate a developer's orooortionate share <br />mitiaation shall be as follows: <br /> <br />Proportionate Share = ('Development students - Available Capacity) x <br />'Total Cost per student station <br /> <br />Where: <br /> <br />'Development students = those students from the development that are <br />assianed to a CSA and have triaaered a deficiencv of the available <br />caoacity . <br /> <br />2Total Cost = the cost per student station as determined and published by <br />the State of Florida. <br /> <br />3. The applicant shall be allowed to enter a 90-dav neaotiation period with the <br />School Board in an effort to mitiaate the impact from the development <br />throuah the creation of additional capacity. Upon identification and <br />acceptance of a mitiaation option deemed finanCially feasible bY the School <br />Board. the developer shall enter into a bindina and enforceable <br />development aareement with the School Board. <br /> <br />a. A mitiaation contribution provided by a developer to offset the <br />impact of a residential development must be directed bv the School <br />Board toward a school capacity proiect identified in the School <br />Board's Five-Year Capital Improvement Plan. Capacity enhancina <br />proiects identified within the first three (3) years of the Five-Year <br />Capital Improvement Plan shall be considered as committed. <br /> <br />b. If capacity proiects are planned in vears four (4) or five (5) of the <br />School Board's Five-Year Capital Improvement Plan within <br />the same CSA as the proposed residential development. the <br />developer mav pay his proportionate share to mitiaate the proposed <br />develooment. <br /> <br />c. If a caoacity proiect does not exist in the Capital Improvement Plan. <br />the School Board will add a capacity proiect to satisfy the impacts <br /> <br />Ordinance 09-1265 <br />Page 4 <br />
