<br />F. Notification of Submittal of Residential Applications. The City shall notify the <br />School Board within fifteen (15) workina davs of receipt of anv land use or <br />development application havina a residential component and will transmit <br />submitted subdivision plans and site plans to the school board for their review. <br /> <br />G. Residential Uses Exempt from the ReQuirements of School Concurrency. <br />The followina residential uses shall be exempt from the reauirements of school <br />concurrency: <br /> <br />1. All sinale familv lots of record at the time the school concurrency <br />implementina ordinance became effective on Januarv 1. 2008. <br />2. Any new residential development that has a preliminarv plat or site plan <br />approval or the functional eauivalent for a site specific development order <br />prior to the commencement date of the School Concurrency Proaram on <br />Januarv 1, 2008. <br />3. Anv amendment to a oreviouslv aooroved residential develooment which <br />does not increase the number of dwellina units or chanae the type of <br />dwellina units. <br />4. Anv aae-restricted community with no permanent residents under the aae <br />of 18 (a restrictive covenant Iimitina the aae of residents to 18 and older <br />shall be reQuired). <br /> <br />H. Level of Service (LOS) Standard. To ensure the capacity of schools is sufficient <br />to supoort student arowth. the City shall apply a lOS standard for schools. The <br />desired lOS standard shall be 100% of the aaareaate permanent FISH capacity <br />for each school tyoe within each CSA. <br /> <br />To financiallv achieve the desired LOS standard at the hiah school level, a tiered <br />LOS standard is established as follows: <br /> <br />Elementarv and Middle <br />School CSA <br />Hiah School CSA <br /> <br />2008-2012 <br />100% of Permanent FISH <br />Ca aci <br />110% of Permanent FISH <br />Ca aci <br /> <br />Be innin 2013 <br />100% of Permanent FISH <br />Ca aci <br />100% of Permanent FISH <br />Ca aci <br /> <br />h Results of Concurrency ReYiew. The City shall not deny development approval <br />due to failure to achieve the adopted lOS for public school facilities when the <br />followina occurs: <br /> <br />1:. Adeauate school facilities are planned and will be in place or under <br />construction within three (3) years of the development approval. <br />2. The developer executes a leaallv bindina commitment to Provide mitiaation <br />proportionate to the demand for oublic school facilities consistent with the <br />methodoloav below. <br /> <br />Ordinance 09-1265 <br />Page 3 <br />
