<br />Planning & Zoning Commission! <br />Local Planning Agency <br />July 8, 2009 <br />Page 4 <br /> <br />Mr. Aramendia asked if there was anyone in the audience who wished to speak in favor of, or in opposition <br /> <br />to, the request. No one came forward. <br /> <br />A general discussion regarding the hours of operation, the extension of the timeframe for the conditional use <br /> <br />approval and modifying condition number 1 to state "that no automotive sales or service activity shall take place on <br /> <br />the property prior to final inspection or project completion". <br /> <br />Mr. Aramendia asked for a motion to address CU 09-04. Mr. Hale made a motion to approve CU 09-04 to <br /> <br />allow an automotive sales and service at 1870 State Road 436 based on the staff report dated July 1, 2009 from <br /> <br />Senzee to the Planning and Zoning Commission, the conceptual site plan dated June 24, 2009, the findings of fact <br /> <br />and conclusions of law and the conditions of approval outlined in the staff report with the following modifications: <br /> <br />1. The applicant shall undergo site plan review within nino (9) twelve (12) months for the subject property <br />in accordance with Chapter IV, Section XVIII "Site Plan Review" of the Casselberry Unified Land <br />Development Regulations. No automotive sales or service activity shall take place on the property prior <br />to site plan approval and sito construction pormit issuanco completion of all construction and <br />inspection. <br />2. The automotive sales and service business shall open for business within nino (9) twelve (12) months <br />of this conditional use approval (April 7, 2010). <br />11. Hours of operation for the automotive sales component shall be soven days :1 woek, 9:00:1m 7:00pm <br />Monday - Friday 9:00 a.m. - 8:00 p.m., Saturday 9:00 a.m. - 6:00 p.m. and Sunday 12:00 p.m. - <br />p.m. The hours of operation for the automotive repair component shall be Monday S:1turdJY 9:00am <br />7:00pm Monday - Friday 7:00 a.m. - 6:00 p.m., Saturday 8:00 a.m. - 5:00 p.m. and closed on <br />Sunday. <br /> <br />Mr. Weinroth seconded the motion. <br /> <br />The Board was polled. <br /> <br />Anthony Aramendia Yes <br />Nathan Van Meter Yes <br />Stanley Weinroth Yes <br />Edmund Sakalla Yes <br />Daniel Hale Yes <br />John VonLangen Yes <br /> <br />The motion passed unanimously. <br /> <br />Fourth Item of Business: Other Business <br /> <br />In response to the Commission's question, Mr. Senzee stated the old Mobil site located at Winter Park <br /> <br />Drive/Red Bug Lake Road will be used as a dry retention pond for the flyover project and the old furniture store site <br />
