possession. <br />Howard Spiegel, Attorney, 1133 Louisiana Ave, Winter Park addressed the Code Enforcement Board. This is a <br />foreclosure property; the fine was primarily imposed under the prier awner who had no vested interest in <br />correcting the property. By the time Washington Mutual was the successful bidder at the property they were <br />unaware of the fine accruing, they were only aware after they got title to the property. At that time they quickly <br />began efforts at continuing maintenance of the property and to bring it up to cede. The purpose of the imposition <br />of the fine is to force code compliance and to penalize the title awner when that is not done. That is lost iri this <br />current situation, because the prier title owner is not the current awner. The current owner had no authority to go <br />rota the property until the time they gained title to make any of the corrections. It is inequitable to maintain that <br />fine far Washington Mutual since they were not responsible at the time. <br />Since they have gained title they made efforts to bring it to cede and actively marketed the property and as was <br />indicated the future owner, who hopes to close by 41/O1J2409 is actively assisting in maintaining the property. <br />They are here to confirm that if the Board wishes to hear from her. <br />Mr. Spiegel requested that the Board minimize the fine and perhaps hold it at administrative fees. Mr. Spiegel felt <br />it would be a fair action for the city to take. <br />Debra Babb-Nutcher asked Mr. Spiegel what he would propane as a dollar ount to reduce the fine and when. <br />would it be paid? <br />Mr. Spiegel stated a nominal amount, $540.00, and a short time limit of 34 days and he would recommend to the <br />client it be paid imrnedaately. <br />Ms. Babb-Nutcher asked if the fine were not reduced that minimally what would be the time frame it would be <br />paid if it were half. <br />Mr. Spiegel stated the new proposed owner wants to close and move in by 41/O1J2049; at that point this lien <br />would have to be eliminated, so payment would be forth coming no later than that closing. Ms. Fullerton needs to <br />get in by O1J41/2409 or she will be homeless. <br />
