CEO Lawrence stated the City was asking for a Finding of non-compliance for the failure to acquire a fence permit for the modifications. Hale made a motion to fmd Respondent in CEB Case # CE-08-03225 in violation of City Code, Section 2-7.10 (A) & (C), and that Respondent correct the violation before 1:00 p.m. 02/10/2009. Another hearing will be held before this Board on 02/12/2009 to determine compliance by the aforestated date, and, if there is no compliance by the aforestated date, a ime in the amount of $25.00 per day will be imposed for each and every day the violation continues past the aforestated date. The Respondent is further ordered to contact the Code Inspector to verify compliance with this Order. Paul L. McKernan seconded the motion. The motion passed unanimously. CE-08-03399 402 Gree:orv Drive/ Nease Overe:rown property 70-2 (C) Marlene Broman, Code Enforcement Officer gave testimony for the above case. As of 01/08/2009 this property remains non-compliant. The City asked for a Finding of Fact with an appropriate fine be imposed if the violation is not in compliance by the date set the Code Board. Robert C. Flint made a motion to fmd Respondents in CEB Case # CE-08-03399 in violation of City Code, Section 70-2 (C), and that Respondents correct the violation before 1:00 p.m. 01122/2009. Another hearing will be held before this Board on 02/12/2009 to determine compliance by the aforestated date, and, if there is no compliance by the aforestated date, a fme in the amount of $50.00 per day will be imposed for each and every day the violation continues past the aforestated date. CE-08-03533 460 Lowndes Square/ Narain Overe:rown property RPT 70-2 (C) Ketron Brown, Code Enforcement Supervisor gave testimony for the above case. Mr. Brown stated as of 01/0112009 there is a fine of $5,275.00 for the previous case and is still running. Lis Pendens has been filed on this property; foreclosure attorney of record has been notified. This violation is a new complaint from a neighbor to the right of the property. As of 01/08/2009 the property remains non-compliant. Mr. Brown stated that due to the risk for rats, snakes, and vermin to breed, and for the health safety and welfare of the community the City asked for authorization to abate and assess the cost for abatement in addition to enhanced fines. Phillip E. Weekley made a motion to imd Respondent in CEB Case # CE-08-03533 in violation of City Code, Section 70-2 (C) and that such violation constitutes a serious threat to the pubic health and welfare, and because this is a repeat violation, pursuant to the Board's original order of 10/15/2008. A ime of $100.00 per day is herby imposed to commence 11/25/2008.
