CITY OF CASSELBERRY CODE ENFORCEMENT BOARD MEETING DECEMBER 11, 2008, page 6 CE-08-02660 518 Jupiter Way Garalde/owner Over2rown property 70-2 (C) Marlene Broman, Code Enforcement Officer, gave testimony for the above case. There has been no contact with the owner and this property has a Lis Appendence filed. As of 12/11/2008 this property was non-compliant, the City was asking for a Finding of Fact and a reasonable fine ifno compliance by the date set by the Code Board. Robert C. Flint made a motion to find Respondent in CEB Case #08-02660 in violation of City Code, Section 70-2 (C), and that Respondent correct the violation before 1:00 p.m. 01/0112009. Another hearing will be held before this Board on 01/08/2009 to determine compliance by the aforestated date, and, if there is no compliance by the aforestated date, a fine in the amount of $25.00 per day will be imposed for each and every day the violation continues past the aforestated date. The Respondent is further ordered to contact the Code Inspector to verify compliance with this Order. Alvera Armour seconded the motion. The motion passed unanimously. Mr. Rivera described photos of this property to the Code Board. As of 12/11/2008 this property was non-compliant, the City was asking for a Finding of Fact and a fine of$50.00 per day be imposed if there is no compliance by the date set by the Board. Discussion. Alvera Armour made a motion to find Respondents in CEB Case #08-02870 in violation of City Code, Section 70-2 (c), and that Respondents correct the violation before 1:00 p.m. 12/18/2008. Another hearing will be held before this Board on 01108/2009 to determine compliance by the aforestated date, and, if there is no compliance by the aforestated date, a fine in the amount of $100.00 per day will be imposed for each and every day the violation continues past the aforestated date. The Respondents are further ordered to contact the Code Iuspector to verify compliance lvith this Order. Kathleen A. Hale seconded the motion. The motion passed unanimously. CE-08-02933 821 N Triplet Lake Drive Grillo/Summerfield Homes/owner Over2rown property 70-2 (C) Luis Rivera, Code Enforcement Officer gave testimony for the above case. This property has a Lis Pendens; the attorney for this foreclosure was contacted on 12/11/2008. The attorney informed Mr. Rivera that the property will be mowed within 10 days. The City requested a Finding of Fact for non-compliance and a fine of $50.00 per day be imposed if no compliance by the date set by the Board. The City also requested an abatement Order be issued if there is no compliance by the set date. Debra Babb-Nutcher, Assistant City Attorney, stated it is generally not recommended that any action be taken on a property where there is a Lis Pendens. Unless the bank is sent Notice they may have a problem with the City taking action. Discussion.
