<br />CITY OF CASSELBERRY <br />CODE ENFORCEMENT BOARD MEETING <br />DECEMBER 11, 2008, page 6 <br /> <br />CE-08-02660 518 Jupiter Way Garalde/owner Over2rown property 70-2 (C) <br /> <br />Marlene Broman, Code Enforcement Officer, gave testimony for the above case. There has been no contact with the <br />owner and this property has a Lis Appendence filed. As of 12/11/2008 this property was non-compliant, the City <br />was asking for a Finding of Fact and a reasonable fine ifno compliance by the date set by the Code Board. <br /> <br />Robert C. Flint made a motion to find Respondent in CEB Case #08-02660 in violation of City Code, Section 70-2 (C), <br />and that Respondent correct the violation before 1:00 p.m. 01/0112009. Another hearing will be held before this Board <br />on 01/08/2009 to determine compliance by the aforestated date, and, if there is no compliance by the aforestated date, a <br />fine in the amount of $25.00 per day will be imposed for each and every day the violation continues past the aforestated <br />date. The Respondent is further ordered to contact the Code Inspector to verify compliance with this Order. <br /> <br />Alvera Armour seconded the motion. <br /> <br />The motion passed unanimously. <br /> <br />CE-08-02870 370 Piney Rid2:e Road MCCoUou2h/owners Trash & debris 70-2(C) <br /> <br />Luis Rivera, Code Enforcement Officer gave testimony tor the above case. Mr. Rivera described photos of this <br />property to the Code Board. As of 12/11/2008 this property was non-compliant, the City was asking for a Finding <br />of Fact and a fine of$50.00 per day be imposed if there is no compliance by the date set by the Board. <br /> <br />Discussion. <br /> <br />Alvera Armour made a motion to find Respondents in CEB Case #08-02870 in violation of City Code, Section 70-2 (c), <br />and that Respondents correct the violation before 1:00 p.m. 12/18/2008. Another hearing will be held before this <br />Board on 01108/2009 to determine compliance by the aforestated date, and, if there is no compliance by the aforestated <br />date, a fine in the amount of $100.00 per day will be imposed for each and every day the violation continues past the <br />aforestated date. The Respondents are further ordered to contact the Code Iuspector to verify compliance lvith this <br />Order. <br /> <br />Kathleen A. Hale seconded the motion. <br /> <br />The motion passed unanimously. <br /> <br />CE-08-02933 821 N Triplet Lake Drive Grillo/Summerfield Homes/owner Over2rown <br />property 70-2 (C) <br /> <br />Luis Rivera, Code Enforcement Officer gave testimony for the above case. This property has a Lis Pendens; the <br />attorney for this foreclosure was contacted on 12/11/2008. The attorney informed Mr. Rivera that the property will <br />be mowed within 10 days. The City requested a Finding of Fact for non-compliance and a fine of $50.00 per day be <br />imposed if no compliance by the date set by the Board. The City also requested an abatement Order be issued if <br />there is no compliance by the set date. <br /> <br />Debra Babb-Nutcher, Assistant City Attorney, stated it is generally not recommended that any action be taken on a <br />property where there is a Lis Pendens. Unless the bank is sent Notice they may have a problem with the City taking <br />action. <br /> <br />Discussion. <br />
