This approval is requested to cover <br />a four year period, the same as the previous approval. <br /> <br />Budget Impact: This item has no impact on the budget. <br /> <br />Recommendation: The City Manager and the Community Development Director recommended approval <br />of the request by Superior Hobbies for additional special events and special event days based on the <br />following conditions of approval: <br /> <br />1. The number of special events conducted at Market Square Shopping Center may not exceed <br />12 events and 24 days for each year during the next four years without obtaining an <br />additional waiver from the City Commission. This waiver shall expire on December 8, <br />2012. <br /> <br />2. A special event permit will be voided by staff should an event be cancelled due to weather, <br />acts of God, strikes or labor disputes, or other related reasons. The cancellation shall be <br />reported to the Community Development Department on the first business day for the City <br />following the cancellation of the event. <br /> <br />3. The special events at the Market Square property shall be conducted based on the scope <br />provided in Exhibit A, Attorney Sam Mackie Letter dated October 29, 2008, which Is <br />attached to and made a part of these minutes. <br /> <br />4. The special events shall be allocated to Superior Hobbies. If Superior Hobbies does not <br />utilize all 12 special events, the property owner has the rightto allocate the remaining events <br />to tenants within the Market Square Shopping Center. <br /> <br />5. Events sponsored by Superior Hobbies or any other hobby event shall be conducted from <br />dawn to dusk on the same calendar day. <br /> <br />6. The layout for mode car racing events shall be aligned perpendicular to SR 436 and shall <br />block no more than one travel lane within the parking lot. <br /> <br />7. High- visibility equipment (i.e. cones, reflective tape) shall always be used to define the <br />location of any event conducted within the parking lot to protect the event and participants <br />form moving vehicles. <br /> <br />8. This waiver shall be in effect for no more than four calendar years form the date of its <br />approval. Any additional waivers will require a new request. <br /> <br />9. This approval shall, in no way, preclude the City's right to withdraw the waiver at any time <br />if, in the City's sole opinion, there is sufficient evidence that the safety of any participant, <br />spectator, or customer of a special event or any other pedestrian or vehicle operator at the <br />Market Square Shopping Center is, or has been, compromised as a result of the event. <br /> <br />10. As per City Code Section 14-44, the applicant for the special event, shall provide the City <br />of Casselberry with a hold harmless agreement, in a form acceptable to the City Attorney, <br />exonerating the City from any and all liability that may occur as a result of special events <br />occurring on his property. <br />
