<br />CITY OF CASSELBERRY <br />CODE ENFORCEMENT BOARD MEETING <br />OCTOBER 09, 2008 PAGE 9 <br /> <br />NEW CASES <br /> <br />CE-08-02387 & 08-02388 1410 Avalon Blvd Equity One Inc.lowners Ovenzrown <br />property 70-2 (C) & Dama2ed windows 1994 SBCCI 305.7-305.13.2 <br /> <br />Marlene Broman, Code Enforcement Officer gave testimony for the above cases. These violations were first <br />observed during a neighborhood inspection on 08/23/2008, Notices were sent to the property owner with a date <br />certain for compliance of 09/08/2008. During a follow-up inspection on 09/1212008 both violations were tound <br />to be non-compliant. Notices were sent and a Request for Hearing on 09/16/2008. As of 10/09/2008 during <br />reinspection there has been no compliance for both violations. The City requests a Finding of Fact and a <br />reasonable fine be imposed if found to be non-compliant by the date set by the Board for overgrown property <br />and the damaged window. <br /> <br />Ketron Brown, Code Enforcement Supervisor stated that given the nature of potential threats to the community <br />for health and safety, because of breeding of mosquitoes and other vermin. The property is now between 2.5 <br />and 3 feet in height. <br /> <br />Robert C. Flint asked if the house is empty. <br /> <br />CEO Broman stated yes it is. <br /> <br />Kathleen A. Hale made a motion to fmd Respondent in CEB Case # 08-02387 & 08-02388 in violation of <br />City Code, Sections 70-2 (C) & 305.7-305.13.2 , and that such violations constitute a serious threat to the <br />public health, safety and welfare, and that Respondent shall correct the violation before 1 :00 p.m., <br />10/23/2008. I further move that should Respondent fall to correct the violation on or before the aforesaid <br />day, that a fme in the amount of $ 25.00 per day will be imposed for each and every day the violations <br />continues. Pursuant to Sections 2-150(d) and2-153(a) of the City Code and Section 162.06(4) and <br />162.09(1), Florida Statutes, the Board requests that the City be notified and that appropriate action be <br />taken to accomplish all reasonable repairs or provide all services necessary, proper or required to bring <br />Respondent's property into compliance, and that the City of Casselberry be entitled to recover its <br />reasonable costs of such repairs or services as part of the Final Order. The Respondent is further <br />ordered to contact the Code Inspector to verify compliance with this Order. <br /> <br />A Subsequent Hearing will be held before this Board on 11/13/2008 to determine compliance by the <br />aforestated date, and, if there is no compliance, that the violation be deemed a repeat violation from the <br />compliance date of the Board's prior Order. <br /> <br />Alvera Armour seconded the motion. <br /> <br />The motion passed unanimously. <br /> <br />CE-08-02463 145 Overbrook Drive Martinez, Jeanetta & Cruz.. Rafael J.lowners <br />overgrown property 70-2 (C) <br /> <br />Michele Lawrence, Code Enforcement Officer, gave testimony for the above case. On 08127/2008 the violation <br />was first observed at this vacant property, research found there is a Lis Pendens, filed on 06/06/2008. Notice of <br />Code Violation was sent the property owners on 08/2812008 with a date certain tor compliance of 09/04/2008. <br />The property was inspected on 09/0812008 found to be non-compliant. Affidavit of Notice of Code Violation <br />and Request for Hearing were mailed on 09/1112008. The City requested a finding of non compliance and that <br />this violation constitutes a serious threat to the public health, safety, and welfare. <br />
