<br />CASSELBERRY CITY COMMISSION <br />Minutes of August 25, 2008 - Regular Meeting <br />Page 11 of 16 <br /> <br />The City Clerk read Ordinance 08-1242 by title as follows: <br /> <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA; AMENDING THE <br />CITY's COMPREHENSIVE PLAN BY AMENDING THE FUTURE LAND USE <br />ELEMENT POLICY FLU 1.6 "LOW INTENSITY NON RESIDENTIAL/MEDIUM <br />DENSITY RESIDENTIAL" TO INCLUDE AN EXEMPTION TO THE THREE ACRE <br />MINIMUM SIZE REQUIREMENT WITHIN SUBSECTION (d); AMENDING POLICY <br />FLU 1.16 "SEMINOLA BOULEVARD SMALL AREA STUDY AREA" TO INCLUDE <br />THE THIRD PHASE OF THE SEMINOLA BOULEVARD SMALL AREA STUDY; <br />PROVIDING FOR TRANSMITTAL OF THE PLAN AMENDMENTS TO THE <br />DEPARTMENT OF COMMUNITY AFFAIRS; PROVIDING FOR CODIFICATION, <br />CONFLICTS, SEVERABILITY AND EFFECTIVE DATE." <br /> <br />Notice of Public Hearing: Notice of Public Hearing for Ordinance 08-1242 was published in the Orlando <br />Sentinel on August 14, 2008. <br /> <br />Introduction: Ordinance 08-1242 accomplishes the following: I) Amends the Future Land Use Element <br />Policy FLU 1.6 "Low Intensity Non Residential/Medium Density Residential" to include an exemption to <br />the three acre minimum size requirements within subsection (d); and 2) Amends the Future Land Use <br />Element Policy FLU 1.16 "Seminola Boulevard Small Area Study Area" to include the third phase of the <br />Seminola Boulevard Small Area study. Justification for both ofthese changes was provided in the Seminola <br />Boulevard East Small Area Study (SBESAS - SB3). <br /> <br />Budget Impact: This item does not impact the budget. <br /> <br />Recommendation: The City Manager and the Community Development Director recommended approval <br />of Ordinance 08-1242 on first reading. <br /> <br />Public Hearing: The following individuals came forward and addressed Ordinance 08-1242: <br /> <br />I) Dr. John Zacco, 601 Queens Mirror Circle, voiced concerns regarding some of the <br />allowed PMX-L uses. <br /> <br />2) Mr. Craig Tull, 429 Ranch Trail, voiced concerns regarding potential drainage impacts <br />to the area with the more intense uses being proposed. <br /> <br />3) Mr. John Casselberry, 700 South Lost Lake Lane, voiced concerns regarding the proposed <br />higher intensity uses for the area. <br /> <br />No one else came forward. Mayor Goff closed the public hearing relative to Ordinance 08-1242. <br /> <br />Discussion: Ms. Lipscomb noted the phase three study was approved by the City Commission in 2006. <br />Discussion ensued regarding conditional uses and the permitted uses in the PMX-L classification, and the <br />recommended percent mix uses within the SB-3 overlay district. Further discussion ensued regarding the <br />impacts and benefits ofthe related sanitary sewer extension project for the area. Commissioner Miller voiced <br />concerns regarding some of the permitted uses in the PMX-L classification. Vice Mayor Hufford voiced <br />
