Planning & Zoning Commission!
Local Planning Agency
July 26, 2006
Page 4

ordinance and resubmit the ordinance to the City Commission. Mr. Henson suggested the following changes to the

prohibited vehicle ordinance:

1. Revise the language to allow ladder racks if not higher than 8 feet tall,
2, Revise the language to allow items in the bed of a pickup truck as long as it does not exceed 8 foot.

The Commission discussed the inaccurate information that citizens are receiving.

Mr. Eugene Miller, Interim City Manager, explained that it was apparent to him that the ordinance before the

governing body was in trouble, He said he interjected before a vote was called to continue the item with the intent

that he would "tweak" the ordinance. Mr. Miller said he is aware of the background, the Planning and Zoning

Commission's efforts, the reasons it was brought before the Planning and Zoning Commission, some of the

processes and the information/misinformation that is being distributed.

Mr, Miller said he would like the opportunity to receive further input regarding the pros, cons, and the reason

for the position and tweak the ordinance, The Planning and Zoning Commission requested to review any changes

that Mr. Miller makes to the ordinance before it is reviewed by the City Commission. Mr. Miller stated that the

Planning and Zoning Commission has made a recommendation to the City Commission and it is in the hands of the

governing body,

A brief discussion ensued regarding enforcement of the current parking ordinance. The Planning and

Zoning Commission said they have received feedback that the enforcement of the parking ordinance is in limbo until
the new code is adopted.
Mr. Miller said he is taking the position as City Manager that the Planning and Zoning Commission has

made their recommendation to the City Commission; however, he would communicate with the Planning and Zoning

Commission members regarding the changes. The Planning and Zoning Commission can then initiate actions as

they please to request it to come back for their additional review. He said he would like to get some communication
and diminish the emotionalism that seems to be driving the issue.

Mr. Burlingame stated that he appreciates and understands the City Manager's position; however, he would
request that Mr. Miller provide any changes to the prohibited vehicle ordinance to the Planning and Zoning

Commission for their review.
