<br />Planning & Zoning Commission! <br />Local Planning Agency <br />June 28, 2006 <br />Page 2 of 14 <br /> <br />Planning Division Staff recommends approval of the rezoning request for the subject property at 750 Seminola <br /> <br />Boulevard, from R-9 (Residential with a minimum lot size of 9,000 sq ft) to RMF-13 (Residential Multi-Family, 13 units <br />per acre), based on the findings of fact and conclusions, the staff report dated June 22, 2006, the property survey <br /> <br />(Attachment B), and the reasons stated in the staff report which are: <br /> <br />1. They are consistent with the City's Comprehensive Plan. <br />2. They are compatible with the surrounding mix of zonings and land uses. <br />3. They will improve the economic redevelopment of the area and will increase property values. <br /> <br />Mr. Kelley asked the applicant to come forward. Mr. Truman Willard, Kingdom Hall Church, said it is the <br /> <br />Church's intention to build on the property. He said there are a few issues that need to be worked out before he can <br /> <br />execute a developer's agreement. <br /> <br />Mr. Kelley asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, <br /> <br />the request. No one came forward. <br /> <br />A brief discussion ensued regarding the execution of a developer's agreement. Mr. Dorsten requested <br /> <br />guidance from the Commission regarding the developer's agreement. Mr. Henson stated his concern is that the <br /> <br />property remains in the hands of the church. Mr. Henson suggested locating the retention ponds to provide buffering <br /> <br />for the adjacent single-family homes. <br />Mr. Kelley asked for a motion to address ZB 06-04. Mr. Henson recommended approval of ZB 06-04 based <br />on the staff memo dated June 22, 2006 to the Planning and Zoning Commission from Mr. Matt Dorsten including the <br /> <br />findings outlined in the staff report and approval is contingent upon successful negotiation of a developer's <br /> <br />commitment to ensure the church use for the property.
