<br />Planning & Zoning Commission! <br />Local Planning Agency <br />May 10, 2006 <br />Page 6 <br /> <br />Fifth Item of Business: SPR 05-24 and SP 05-04: Centex/Legacv Park Residential. Site plan and replat review for the <br />townhome portion of Legacy Park Residential Phases 1 and 2 to provide all townhomes with two car garages. <br /> <br />Ms. Sandra Smith, Acting Community Development Director, reviewed the information provided in her memorandum <br /> <br />dated May 3, 2006, to the City of Casselberry Planning and Zoning Commission (a copy is on file in the Community <br /> <br />Development Department). Ms. Smith corrected condition number 1 for the subdivision plan to read: "The Planning and <br /> <br />Zoning Commission supports the side yard setback modifications for Lots 106 and 128 from fifteen feet to 0 feet along the <br /> <br />driveway of Lot 106 and from 15 feet to.:t-9 .1Q.5 feet on Lot 128". <br /> <br />Mr. Kelley asked the applicant to come forward. Mr. Tom Daly, 604 Courtland Street, Suite 202, Orlando, Florida <br /> <br />came forward. Mr. Daly stated he agrees with staff's recommendation. Mr. Daly stated that the modification provides a higher <br /> <br />value product. <br /> <br />Mr. Kelley asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, the <br /> <br />request. Mr. John Casselberry, 700 South Lost Lake Lane, Casselberry, Florida came forward. Mr. Casselberry expressed a <br /> <br />concern that his family may have an interest in the property based on a stock certificate in his father's trust. Mr. Casselberry <br />stated he has done some research regarding this matter. <br /> <br />After a brief discussion, Mr. Kelley asked for a motion to address SPR 05-24. Mr. Buchanan recommended approval <br />of SPR 05-24 based on the staff memo dated May 3, 2006 including the findings in the report and changing condition number <br />one on page 3 to read: "The Planning and Zoning Commission supports the side yard setback modifications for Lots 106 and <br /> <br />128 from fifteen feet to 0 feet along the driveway of Lot 106 and from 15 feet to .:t-9.1Q.5 feet on Lot 128". Mr. Henson <br /> <br />seconded the motion. The motion passed unanimously by voice vote. <br /> <br />Mr. Buchanan recommended approval of SP 05-04 with the same recommendations as pointed out in the May 3, <br />2006 staff report from Ms. Sandra Smith and the correction to the lot size. Mr. Henson seconded the motion. The motion <br /> <br />passed unanimously by voice vote. <br /> <br />Sixth Item of Business: LPA 06-04: ULDR Section 3-10.9. Parking of vehicles in residential districts. Public Hearing of <br />an ordinance establishing criteria for prohibited vehicles, including parking and screening requirements. <br /> <br />Ms. Sandra Smith, Acting Community Development Director, reviewed the information provided in her memorandum <br /> <br />dated May 3, 2006, to the City of Casselberry Planning and Zoning Commission (a copy is on file in the Community <br />Development Department). A lengthy discussion ensued regarding Section 3 page 5 and the following change was made: <br />
