<br />Planning & Zoning Commission! <br />Local Planning Agency <br />May 10, 2006 <br />Page 4 <br /> <br />Based on the site plan dated May 3, 2006, the findings of fact and COhclusions of the staff report dated May 5, 2006, and the <br />following conditions: <br /> <br />1. The comments generated by Public Works during the site plan review shall be satisfied and all preliminary plat <br />issues shall be resolved prior to the issuance of a site construction permit by the City of Casselberry. <br />2. The master retention area shall be upgraded and maintained in conjunction with the building permit for this <br />project. <br />3. All applicable Federal, State, County and other reviewing agency permits shall be submitted to the City prior to <br />the issuance of a building permit. <br />4. The photometric plan (Sheet E-3) is approved as proposed. A note shall be added stating that the height of the <br />site lighting fixtures shall not exceed 20 feet above the finished grade. <br />5. All deliveries made via semi-tractor trailer shall be conducted prior to 8AM and/or after 5PM. <br />6. No future service related facilities (i.e., teller box, ATM, call box, order station, etc.) shall be allowed in <br />conjunction with the bypass lane. <br />7. The architectural features, such as the awnings and downlight fixtures on the south and east faces of the <br />12,850 square foot building, should be continued to the north and west sides, above the rear exit doors. <br />Additionally, a shrub row shall be placed at the based of the 12,850 square foot building where sod is <br />proposed. <br />8. The applicant shall provide irrigation and shrubs in the median between the Burger King drive-through and the <br />BB& T Bank drive-through. <br />9. The landscape plan and tree replacement proposal to donate $2,025 to the City's Tree Bank Fund is approved <br />and shall be executed prior to the issuance of any permits by the City. A reduction of the Tree Bank <br />Contribution may be allowed post site plan approval, should the applicant propose a landscape plan illustrating <br />an increase in proposed trees and/or shrubs. <br />10. The applicant will provide thermoplastic striping, interior signage, and wheel stops in the nose-to-nose parking; <br />in the existing parking area adjacent to Burger King. <br />a. The two handicap parking spaces to the west of Burger King shall share a 60-inch wide access <br />isle. <br />b. From the handicap access isle to the sidewalk ramp, the applicant shall provide a striped <br />crosswalk. <br />11. All sign age for the site shall conform to the City's ULDR and shall be submitted as a separate building permit. <br />12. All applicable occupational licenses shall be obtained prior to the commencement of all business activities at <br />the site. <br />13. The site plan approval shall be valid for one year upon approval by the Planning and Zoning Commission. An <br />extension request must be submitted prior to the expiration. <br />14. All general notes included in the site plan package shall be adhered to and followed by the applicant, the <br />property owner, future operators/tenants and their successors and assigns. <br />15. The site shall be maintained in accordance with ULDR Section 3-10.3 Minimum Maintenance Standards and <br />Guidelines. <br />16. All of the above conditions shall be fully and faithfully executed or the site plan shall become null and void. <br /> <br />CONDITIONAL USE (CU 05-14) <br /> <br />Based on the approved site plan dated May 3, 2006, the findings of fact and conclusions of the staff report dated May 5, 2006, <br />and the following conditions: <br /> <br />1. The restaurant will be constructed in accordance with the site plan approval for SPR 05-22. <br />2. Hours of operation shall be Monday through Sunday from 6:00 AM to 10:00 PM. <br />3. All tables, chairs and umbrellas utilized on the patio shall be stored indoors when the business is not in <br />operation. <br />4. The applicant shall obtain and keep current, all occupational licenses. <br />
