Ms. Smith stated staff recommends approval of the proposed revisions to Development Order 02-08 based on <br /> <br />the staff report dated March 22, 2006, the attached Exhibits, and the following condition: <br /> <br />1. Pathways to Care shall apply for a site plan modification to provide a designated outdoor location with <br />permanent seating and tables near the screened porch within 30 days of the Planning and Zoning <br />Commission approval of the revised development order. Parking spaces adjacent to the area may be <br />converted to an outdoor seating area if excess parking spaces exist. Construction of the seating area shall <br />be completed within 60 days of site plan approval. <br /> <br />Mr. Henson suggested fencing the designated outdoor location. <br /> <br />Mr. Henson asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, the <br /> <br />request. <br /> <br />Mr. Roger Lenzen, 8 Lotus Lake Drive, Casselberry, Florida came forward to speak against the request. Mr. Lenzen <br /> <br />gave a history of the original development order. Mr. Lenzen said he was concerned with the patients roaming the <br /> <br />neighborhood. He said there is no staff supervision. Mr. Lenzen felt that it was changing from a medical facility to a homeless <br /> <br />shelter. Mr. Lenzen stated that the patients are staying at the facility longer than the six weeks as agreed to originally. Mr. <br /> <br />Lenzen was concerned with the enforcement of the rules. He asked staff about the enforcement of the rules and he said no <br /> <br />one could tell him who enforces the rules for the facility. Mr. Lenzen was concerned with the changes made to the <br /> <br />development order and the enforcement of the development order. <br /> <br />Mr. C.L. Cooper, 18 Lotus Lake Drive, Casselberry, Florida came forward. Mr. Cooper said he has read the <br /> <br />development order. He said he has witnessed patients from Pathways to Care on his property by the lake. Mr. Cooper said <br /> <br />that he spoke with the Mayor regarding the problems. He said the Mayor said he talked with Pathways to Care and they <br /> <br />would correct the problem. Mr. Cooper said the facility and the property owner are not abiding by the rules. <br /> <br />Ms. Ann Cooper, 18 Lotus Lake Drive, Casselberry, Florida came forward. Ms. Cooper said she appreciates the fact <br /> <br />that the facility is helping people and that the property is well maintained. Ms. Cooper stated she was concerned about the <br /> <br />facility and spoke with Mr. Schluckbier and Mr. Wells. She said she was told that the majority of the patients would be elderly <br /> <br />and would need a few days care after being released from the hospital. She said Mr. Wells provided a copy of the contract for <br /> <br />the facility and she felt that it would not be a detriment to the neighborhood. Ms. Cooper stated that the facility is different than <br /> <br />what was represented in the contract. <br />
