<br />Board of Adjustment <br />October 26, 2006 <br />Page 3 <br /> <br />After a brief discussion regarding the variance criteria, Mr. Billerbeck asked for a motion for BA 06-14. Mr. Miller made a <br /> <br />motion to approve BA 06-14 with the following findings and conditions of approval: <br /> <br />1. Criteria number 1, 3, 4 and 6 are met based on the staff report. <br />2. Criteria number 5 is met due to the change in elevation and location of the pool which eliminated the of <br />6 foot <br />3. Criteria number 2 is met due to special conditions and circumstances did not result from the applicant's negligence <br />because there was a change in elevation. <br />4, Including the conditions of approval outlined in the staff <br /> <br />Mr. Bowman seconded the motion, <br /> <br /> <br />was polled, <br /> <br />Mary Anne Gauvin <br />McMullen <br />Ed Bowman <br />Hal Billerbeck <br />Jonathon Miller <br /> <br /> <br />The motion passed unanimously. <br /> <br />Fourth Item of Business: Other Business. <br /> <br />Mr, Charles Senzee, Planner introduced Mr, Tim McClendon, Planner, to the Board of Adjustment Board. <br /> <br />A discussion ensued regarding the City Commission's decision regarding the appeal of the variance request for 20 <br /> <br />Cobblestone and the appeal procedure. Mr. Bowman <br /> <br />he wrote a letter to the City Commissioners regarding the appeal <br /> <br />decision and Ms, Hufford and Ms. Doerner responded to his letter. <br /> <br />Mr. Bowman made a motion that his letter would include the Board of Adjustment Board member's names and it would be <br /> <br />sent to the City Commission stating that Board of Adjustment's decision was made with proper justification, Mr. McMullen <br /> <br />seconded the motion. The Board was polled and the motion passed unanimously, <br /> <br />There being no further business to come before the Board, motion was <br /> <br />and <br /> <br />to adjourn, <br /> <br />of the meeting are available as a matter of public record. <br /> <br /> <br />
