Mr. Witanowski said he contacted the adjacent neighbors regarding the structure and the neighbors were <br /> <br />supportive of the structure, <br /> <br />Ms. Renee distributed and reviewed photographs of the property (copies are attached and made a part of the <br /> <br />minutes). Ms, Renee said the structure would be used to <br /> <br />art materials and family possessions. She said the shed <br /> <br />would provide a secure location that is easily accessible to the items. Ms. Renee explained that the location of the shed <br /> <br />was placed to provide the least visibility to the adjacent neighbors. <br /> <br />Ms, Renee reviewed possible locations for the <br /> <br /> <br />that one location would require removal of trees <br /> <br /> <br />other location was too <br /> <br />to the house. <br /> <br />Ms. Renee stated the shed was constructed based on the misconception that if the work was done by the <br /> <br />homeowner a permit was not needed. <br /> <br />In response to the Board's question, Mr. Witanowski said a separate electric line needed to be connected from <br /> <br />the utility box to the structure and it was at that time he was notified by the electrician that it would require an inspection <br /> <br />from the City Building Inspector. He said it was not a code enforcement complaint. <br /> <br />Mr. Billerbeck stated this item was continued from the July 27,2006 meeting due to an advertising error. <br /> <br />Mr. Charles <br /> <br /> <br />Planner, reviewed the background information and the analysis of the request, provided in <br /> <br />his memorandum to the Board of Adjustment, dated August 16, 2006 (a copy is on file in the Community Development <br /> <br />Department). Mr. Senzee stated the variance application does not meet all of the criteria for granting the variances; <br /> <br />therefore, City staff cannot support the request. <br /> <br />Mr. Senzee said If the Board of Adjustment chooses to grant the variance requested for BA 06-11, for the <br /> <br />property located at 20 Cobblestone Court, to allow a 12-foot encroachment into a rear yard building setback, the motion <br />should be based upon the Board of Adjustment's findings of fact and conclusions, the property site plan (Exhibit B) dated <br /> <br />September 12, 1968, and the conditions stated in the staff report which are: <br /> <br />1. The variance shall only pertain to the 352 sq ft accessory structure which encroaches 12' into the rear yard <br />building setback, as shown in Exhibit B. <br />2. The structure shall meet all other site development criteria. <br />3. The accessory structure shall not be used as a dwelling unit or for a commercial use. <br />
