<br />CITY OF CASSELBERRY <br /> <br />BOARD OF ADJUSTMENT <br /> <br />The City of Casselberry Board of Adjustment held a public hearing on Thursday, August 2006, at 6:30 P.M., <br /> <br />in <br /> <br />City Hall Commission Chambers, Triplet Lake Drive, Casselberry, Florida. <br /> <br />Members present were: <br /> <br />Hal Billerbeck, Chairman <br />Ed Bowman, Vice-Chairman <br />Jonathon Miller <br />Mary Anne Gauvin <br />Luis Guzman (alternate) <br /> <br />Members absent were: <br /> <br />Earl McMullen <br /> <br />Staff members present: <br /> <br />Charles Senzee, Planner <br />Sandra Smith, Acting Community Development Director <br />Joni Dixon, Sr. Staff Assistant <br /> <br />First Item of Business: Approval of Minutes for the public hearing held on Thursday, July 27, 2006. <br /> <br />Mr. Billerbeck stated the Chair would entertain a motion on the approval of the minutes for the public hearing <br /> <br />held on Thursday, July 27, 2006. Mr. Bowman moved to accept the July 27,2006 minutes. Mr. Miller seconded the <br /> <br />motion. The motion passed unanimously. <br /> <br />Second Item of Business: Disclosure of Ex Parte communications. <br /> <br />There was no disclosure of ex-parte communications. <br /> <br />Third Item of Business: BA 06.11: 20 Cobblestone Court. John Witanowski and Lisabeth Renee Continued. <br />Variance request to Chapter II, Article VII, Section 2-7.9 "Accessory Structure," and Table 2-5.4 "Size and <br />Dimension Regulations," to grant a 12-foot encroachment into a rear yard building setback, creating an S-foot <br />rear yard building setback in lieu of the required 20-foot rear yard building setback. <br /> <br />Mr. Billerbeck asked the applicant to come forward. Mr. John Witanowski and Ms. Lisabeth Renee, 20 <br /> <br />Cobblestone Court, Casselberry, Florida came forward. Mr. Witanowski stated that the building was constructed without <br /> <br />a permit based on incorrect information received from a contractor. Mr. Witanowski said the building has been <br /> <br />constructed to exceed code requirements and the structure would withstand hurricane force winds of approximately 140 <br />
