<br />Board of Adjustment <br />May 25,2006 <br />Page 2 <br /> <br />variance request for BA 06-04, for the property located at 41 0 Diane Court, for a 5-foot encroachment into a required rear <br /> <br />yard building setback, creating a 15-foot rear yard in lieu of the required 20-foot rear yard; the motion should be based <br /> <br />upon the Board of Adjustment's findings of fact and conclusions, the property site plan (Exhibit B) dated May 31, 1988, <br /> <br />and the following conditions: <br /> <br />1. The variance shall only pertain to the proposed addition. <br />2. A building permit for the addition shall be obtained from the City's Building Safety Bureau within 60 days of the <br />approval by the Board of Adjustment and a final inspection shall be obtained with 180 days of the issuance of <br />the building permit. <br />3. All of the above conditions shall be fully and faithfully executed or the variance shall become null and void. <br /> <br />In response to the Board's question, Mr. Dorsten stated that the Code does not allow for an expansion to a non- <br /> <br />conforming use. The required size of the garage was discussed briefly. <br /> <br />After a brief discussion, Mr. Billerbeck asked the applicant to come forward. Mr. Scott Brasol explained that the <br /> <br />garage would meet the required size. Mr. Brasol stated he is part owner in a custom renovations business and assured <br /> <br />the Board that the project would be completed in a timely manner. <br /> <br />Mr. Billerbeck asked if there was anyone in the audience who wished to speak in favor of the request. Mr. Scott <br /> <br />Hudson, 785 Diane Circle, Casselberry, Florida came forward to speak in favor of the request. Mr. Hudson had no <br /> <br />objection to the construction of the proposed addition. <br /> <br />Ms. Fran Sullivan, 400 Diane Court, Casselberry, Florida came forward to speak in favor of the request. Ms. <br /> <br />Sullivan stated any improvements Mr. Brasol makes to his home is an improvement to the neighborhood. <br /> <br />Mr. Tim Sullivan, 400 Diane Court, Casselberry, Florida came forward to speak in favor of the request. <br /> <br />Mr. Tom Erskine, 420 Diane Court, Casselberry, Florida came forward to speak in favor of the request. Mr. <br /> <br />Erskine stated he had no objection to improving the neighborhood. <br /> <br />Mr. Billerbeck asked if there was anyone in the audience who wished to speak in opposition to the request. No <br /> <br />one came forward. <br /> <br />There were no general comments or closing statements from the applicant or the City. <br />After a brief discussion, Mr. Billerbeck asked for a motion for BA 06-04. Mr. Miller made a motion to approve BA <br /> <br />06-04 conforming to the City's criteria number 1 and number 6 and the following: <br /> <br />1. Criteria number 2 -It is not a condition created by the applicant because it existed prior to purchase to the <br />property. The structure had been in place since 1979. <br />
