Chief Planner: Ordinance 07-1228 amends the Unified <br />Land Development Regulations (ULDR) Section 2-7.26, Seminola Boulevard Overlay District <br />(SBOD) Design Guidelines (LPA 07-01). The applicant, Geneva School, is requesting these <br />amendments in conjunction with their request to amend the Conceptual Plan for the Legacy Park <br />Planned Development (SPR-07-01). The applicant will be paying a recreational impact fee of <br />over $320,000 for the residential units going into the park. These fees will be utilized for new <br />City parks or improving the existing parks. The amendments to the design guidelines are listed as <br />follows: <br /> <br />· Allowing condos within the design requirements for apartments. A condominium is <br />owner-occupied versus an apartment which is occupied by a lessee. This is basically <br />providing an additional descriptor: the design criterion is the same. <br />. Active Parks - Eliminating public use of the "active parks" within the Seminola <br />Boulevard Overlay District Guidelines. The park, when owned by the Church had the <br />potential to be used by the residents of Legacy Park and the public. The proposed use is <br />for a private school, and due to safety and liability concern, the park will not be available <br />for public use. <br />. The term "school" replaces the term "places of worship" and "church" throughout the <br />guidelines. The term "school" is defined and various design elements have been affected <br />to produce the fal'ade. <br /> <br />Staff Recommendation: Approval of Ordinance 07-1228 as presented and schedule the final <br />public hearing for November 13,2007. <br /> <br />Audience Input: <br /> <br />I) Jon Walls, Project Manager, CNL Real Estate, 631 South Orlando Avenue, Winter <br />Park, Florida, was present on behalf of the applicant to respond to questions. <br /> <br />Commissioner Hufford expressed concerns regarding the vinyl coated chain link fence that <br />replaced the wall in the conceptual plan for Legacy Park. Ms. Smith stated that chain link <br />fencing was permissible but this would be reviewed during the site plan review process. <br /> <br />MOTION: <br /> <br />Moved by Vice Mayor/Commissioner Susan Doerner to approve <br />Ordinance 07-1228. ULDR Amendments to Seminola Boulevard <br />Overlay District Design Guideliues, as presented. Motion was <br />seconded by Commissioner Jon Miller and carried unanimously on a <br />5 - 0 voice vote. <br />
