RESOLUTION 08-1926 "A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE EXECUTION OF CHANGE ORDER NO. 1 TO AN AGREEMENT BETWEEN COM, INC. AND THE CITY OF CASSELBERRY TO PROVIDE ADDITIONAL ENGINEERING DESIGN AND PERMITTING SERVICES FOR THE LAKE CONCORD STORMWATER PARK (ALSO KNOWN AS ANNIVERSARY PARK) PROJECT; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." WHEREAS, the City of Casselberry has been planning the construction of a park in the area between City Hall and portions of Lake Concord; and WHEREAS, the lake Concord Stormwater Pari< integrates water quality improvement projects that are an important part of the City's participation in programs to meet Total Maximum Daily load (TMDl) and National Pollutant Discharge Elimination System (NPDES) regulations; and and WHEREAS, the Pari< will serve as a gathering place and educational tool for the citizens of Casselberry; WHEREAS, the City and its associated Communily Redevelopment Agency have previously approved the funding .for design of a pari< at this location; and WHEREAS, additional design services from the City's consultant, CDM, Inc. are necessary in order to meet permit requirements from the SI. Johns River Water Management District (SJRWMD) and to address other design elements of the pari<; and WHEREAS, City staff has reviewed Change Order No.1 submitted by CDM, Inc. and finds iI favorable to the City. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the CiIy of Casselberry hereby approves Change Order No. 1 to the Agreement with CDM, Inc. in the amount of $77,773, which includes an optional SJRWMD response ilem for $5,597, attached as "Attachment A". SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION III. Severabilitv. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution.
