<br />Board of Adjustment <br />March 27, 2008 <br /> <br />Page 5 <br /> <br />Mr. Bowman expressed a concern that the Board of Adjustment was approving a zoning issue and he felt this item <br /> <br />should be reviewed by the Planning and Zoning Commission. Mr. Senzee explained that the Planning and Zoning <br /> <br />Commission never reviewed the project because the extent of the renovations did not generate a major site plan review. <br /> <br />A discussion ensued regarding the landscaping on the site. Mr. Senzee explained when reviewing redevelopment <br /> <br />of a noncompliant site the Code allows staff to address parking and landscaping issues. He said staff determines if the <br /> <br />site has adequate parking and attempts to bring the landscaping up to current Code requirements. Mr. Senzee said it is <br /> <br />challenging to place landscaping on a fully developed site. He said staff has requested applicants to remove asphalt on <br /> <br />projects in the past but it is very rare. Mr. Senzee said the site has been grandfathered in; therefore, staff cannot require <br /> <br />the removal of the asphalt on the site, <br /> <br />He said staff works with the area to make it more visually appealing. Mr. Senzee explained there are several <br /> <br />dumpsters located at the rear of the site which are not screened. He said the site could not meet the Code requirement <br /> <br />for the screening of the dumpsters; therefore, staff requested the applicant add walls at the rear of the property to provide <br /> <br />screening for the dumpsters. <br /> <br />Mr. Bowman asked the applicant to come forward. Mr. JosefTyree, electrical contractor, Power Electric Services, <br /> <br />Inc., 4714 East HiIlsborough Avenue, Tampa, Florida came forward. Mr. Tyree reviewed the light design for the shopping <br /> <br />center. Mr. Tyree said the lighting is designed to give an even spread of lighting throughout the shopping center and it <br /> <br />would more closely conform to the current lighting code requirements. <br /> <br />Mr. Charles Letizia, architect, Island Designs, Inc., 11911 U.S. Highway One, Suite 205, North Palm Beach, <br /> <br />Florida came forward. Mr. Letizia said the scope of the improvements to the site did not trigger a compliance with <br /> <br />current landscape code. He said staff requested the applicant provide a current landscape document that would be <br /> <br />added to the file as the permanent record. He said he is working with staff on the landscaping requirements. Mr. Letizia <br /> <br />said it is a distressed property. He said that Sav-A-Lot will open May 1, 2008. <br /> <br />Mr. Letizia said he has been with the Dark Sky protocol for 15 years and he has been advocating it for years. He <br /> <br />said today's light fixtures can control the footprint of the light. He felt that the glare that resulted from the height of the <br /> <br />poles generated the concern. He said State Road 436 has 45' pole mounting heights with cobra heads that are not Dark <br />
