<br />RESOLUTION 08-1921 <br /> <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, TO CONVEY A <br />UTILITY FACILITY EASEMENT TO PROGRESS ENERGY FLORIDA, INC., <br />PROVIDING FOR CONFLICTS, SEVERABlLlTY, AND EFFECTIVE DATE." <br /> <br />WHEREAS, the City of Casselbeny, as part of the Subordination of Utility Interests Agreement <br />requirements from Progress Energy Florida, Inc., as related to the North Winter Park Drive Realignment Project; <br />and <br /> <br />WHEREAS, the City of Casselbeny has a vacant platted twenty-five (25') wide right-of-way suitable to <br />convey as part of the Utility Facility Easement; and <br /> <br />WHEREAS, City staff have reviewed the proposed Utility Facility Easement Agreement and <br />recommends approval. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS FOLLOWS: <br /> <br />SECTION 1. The City Commission of the City of Casselbeny hereby approves the Utility Facility <br />Easement Agreement (attached "Attachment A", and authorizes the Mayor to execute said document on behalf of <br />the City. <br /> <br />SECTION n. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of <br />this Resolution are hereby repealed. <br /> <br />SECTION m. Severability. If any Section or portion of a Section of this Resolution proves to be <br />invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any <br />other Section or part of this Resolution. <br /> <br />SECTION IV. Effective Date.
