<br />GENERAL INSTRUCTIONS TO RESPONDENTS
<br />
<br />1. Definitions. The definitions found in s. 60A-1.001, F.A.C. shan apply
<br />10 this agreement The following additional lerms are also defined:
<br />(a) ~8uyer~ means the entity thai has released the solicitation. The
<br />~8uyerM may also be lhe MCus'omer~ as defined in Ihe PUR 1000
<br />if that enlily meels the definition of bolh lerms.
<br />(b) "Procurement Officer" means the Buyer's conlracting personnel,
<br />as identified in the Introductory Materials,
<br />fe) "Respondent" means the entily thaI submits materials 10 the
<br />Buyer in accordance with lhese Instructions.
<br />(d) "ResponseM means lhe material submitted by the respondent in
<br />answering the solicilation.
<br />(e) "Time!ine~ means the list of crilical dales and actions included in
<br />the IntroduClory Malerials.
<br />
<br />2, General Instructions, POlential respondenls 10 Ihe solicilation are
<br />encouraged 10 carefully review alllhe male rials contained herein and
<br />prepare responses accordingly.

<br />'3. Electronic Submission of Responses, Respondenls are required
<br />10 submit responses electronically. For this purpose, all references
<br />herein to signa lures, signing requirements, or other required
<br />acknowledgments hereby include electronic signalure by means of
<br />clicking Ihe "Submit Response" bullon (or other similar symbol or
<br />process) aUached 10 or logically associaled with the response created
<br />by the respondent within MyFloridaMarkelPlace. The respondenl
<br />agrees Ihal Ihe action of electronically submilllng its response

<br />4. Terms and Conditions. All responses are subjecllo the terms of the
<br />following sections of lhis solicilalion, which, in case of connict, shall
<br />have the order of precedence lisled:
<br />Technical Specifications,
<br />Special Condilions and Instructions.
<br />Instructions to Respondents (PUR 1001),
<br />General Conditions (PUR 1000), and
<br />Introduclory Materials.

<br />The Buyer objects 10 and shall nol consider any addilionallerms or
<br />conditions submiHed by a respondent, inclUding any appearing in
<br />documenls all ached as part of a respondent's response. In submilllng
<br />Us response, a respondent agrees Ihal any additional terms or
<br />conditions, whether submiUed intentionally or inadver1enlly, shall have
<br />no !orce or effecl. Failure to comply with terms and conditions,
<br />including lhose specifying inrormalion thai musl be submilled with a
<br />response, shall be grounds for rejecting a response.

<br />"5. Quesllons. Respondents shall address alf questions regarding this
<br />solicilalion to Ihe Procurement Officer. Queslions musl be submitted
<br />via the O&A Board within MyFloridaMarketPlace and must be
<br />RECEIVED NO LATER THAN the time and dale renected on Ihe
<br />Timetine, Queslions shat! be answered in accordance wilh Ihe
<br />Timeline. All questions submitted shall be published and answered in
<br />a manner thaI all respondents will be able to view. Respondents shall
<br />nol contact any olher employee of the Buyer or the Stale for
<br />Information.. with. respect .10 . (his. solicitation.' Each respondent Is
<br />responsible for monitoring the MyFloridaMarketPlace site for new or
<br />changing information. The Buyer shall nol be bound by any verbal
<br />information or by any written informalion lhat is nol conlafned wilhln
<br />the solfcilaHon documents or formally noticed and issued by the
<br />Buyer's contracling personnel. Questions to the Procurement Officer
<br />or to any Buyer personnel shall nol constitule formal protest of the
<br />specifications or or the solicitation, a process addressed in paragraph
<br />19 of lhese Instrucllons.
