<br />RESOLUTION 08-1920 <br /> <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, <br />CONFIRMING THE CITY'S INTENT TO ENTER INTO A <br />MAINTENANCE MEMORANDUM OF AGREEMENT WITH THE STATE <br />OF FLORIDA, DEPARTMENT OF AGRICULTURE AND CONSUMER <br />SERVICES, FOR AN URBAN AND COMMUNITY FORESTRY GRANT, <br />IF THE GRANT IS AWARDED; PROVIDING FOR CONFLICTS, <br />SEVERABILITY, AND AN EFFECTIVE DATE." <br /> <br />WHEREAS, the City of Casselberry submitted an application to the State of Florida, Department <br />of Agriculture and Consumer Services, for a 2008 Florida Urban and Community Forestry Grant in the <br />amount of $5,000; and <br /> <br />WHEREAS, the City of Casselberry wishes to establish and maintain a tree planting program as <br />outlined in the grant proposal; and <br /> <br />WHEREAS, the City of Casselberry takes a very proactive role in the establishment and <br />maintenance of trees located within the City; and <br /> <br />WHEREAS, if awarded the grant, the City of Casselberry wishes to enter into a Maintenance <br />Memorandum of Agreement with the Florida Department of Agriculture and Consumer Services to care <br />for and maintain the trees after planting. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY <br />OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br /> <br />SECTION I. The City Commission supports the tree planting project as outlined in the grant, <br />agrees that the City of Casselberry will enter into the Maintenance Memorandum of Agreement with the <br />Florida Department of Agriculture and Consumer Services, and authorizes the Mayor to execute the final <br />Maintenance Memorandum of Agreement, if received, on behalfofthe City. <br /> <br />SECTION U. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br /> <br />SECTION m. Severabilitv. If any Section or portion of a Section of this Resolution proves to be <br />invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect <br />of any other Section or part of this Resolution. <br /> <br />SECTION IV. Effective Date.
